No refund of advance amount

Hello,

We have paid advance amount to one of our supplier six months ago. He is not paying the money back. What should be advisable action against hi.

Sir,

 

If the money is paid through cheque or on a written agreement then you should claim the money back by sending the legal notice, otherwise as well if it is paid in cash then also you can claim but in case of cash it becomes little difficult to prove sometimesw otherwise.

In order to recover your advance amount you need to look at the terms and conditions that you may have signed or agreed with your supplier. This should give you the full story ie you will be able to visualise if he is going according to the terms and conditions that you had agreed with. If not then you can sue him in court to recover your amount including your legal costs. The question is have you signed a written agreement with your supplier or was it just a verbal agreement? verbal and written agreement of basically the same the only difference is it is harder to prove the verbal agreement.
