Affidavit

Railways wants Affidavit from Ist Class Judicial Magistrate for sanction of Family Pension. There is no Ist Class Judicial Magistrate in Visakhapatnam. Will Affidavit from Metropolitan Magistrate do the purpose ?

Contact your area Sub-Divisional Magistrate in Visakhapatnam or any other officer empowered for the purpose.

Search their will be JMFC  in vishakapatnam.

To my knowledge, no such affidavit is required if the PPO has incorporated the partitculars of the entitled family pensioner. Please ascertain the rule under which the said affidavit is being insisted.

No sir.  In some cases for widows, the widows' daughter/sister who are dependent is allowed to get a person but they have to file the affidavit. There is a JFMC court in Visakhapatnam.

Sir, this is the case of pension to an unmarried daughter where the applicant has three more married sisters. So, the Railways want an affidavit and no-objection certificate duly sworn before Ist Class Judicial Magistrate.

Duties and powers of JMFC and Magistrate 1st class are different, which cannot be interchanged as JFMC performs judicial functions whereas Magistrate 1st class is an administrative duty performed by some promotee or IAS Officer.

The requisite affidavit, has to be authenticated by Magistrate 1st class.  However, if it is attested by JMFC, it will also have to be accepted by the department.

Please check with the department (Railways) Surviving Member Certificate / Legal Representative Certificate issued by area Tehsildar / SDM should suffice.
