Hi , i am sarla living in Co-operative group housing society (regd.) from 1983 in New Delhi. Our society has 4multi-story 7th floored building with lift and more than 15small 4th floored non-lift building . Our society office charge Rs400/month from each flat as maintenance charges from non-lift building for services (secuirity guards on main gate , electrician , plumber , gardener, water supply , sweeper for cleaning society roads and buildings staircase) and charge Rs600/month from each flat for same services including Rs200 for lift charges from lift buildings.
In year2000 , Our society has given rights to welfare associations made by lift buildings flat owners on their own to maintain & charge for lift themselves i.e Rs200/flat except electricity for lift . Welfare associations added more services on their own like 1gaurd for 24hrs and extra sweeper for cleaning buildings staircase resulting monthly charges increased to Rs600/month for each flat and they made compulsary to pay for everyone . Now , 2nd to 7th floor are ready to pay for all services but we 1st floor are not ready . Society office saying that they have passed this responsibility in general body meeting . Can Society office have right to pass this type of resolution ?
Our society office stopped plumber , electrician services to attend and also not giving Non-dues certificate but we paid all society office bills upto date until we do not pay welfare association bill with interest 18%p.a( for late payment).
When we visited lift department we get to know that these lifts don't have licences to run since society built .
Can they have right to demand bill even when they don't have lift licences?
They made total Rs90000(including interest 30000) till now which includesRs.15000 for renewation of building .
Questions:-1. Can society have right to distribute their responsibility to buildings un-registered & non-auditing welfare association ?
2. Can society office stop services or stop giving No dues Certificate for not paying buildings welfare associations bill ?
3. Can building welfare association charge their bill with interest ?
4. Where should i appeal first (Registrar office or consumer court or lower court )?
