Repairing expenses

Our building is registered under Apartment act. There are 8 apartments.The apartment has completed 25 years.For nearly 15 years ago wear and tear of the building began,but we have sorted it  amicably.But out of 8  flat owners  2 flat owners have seepage in their bathroom and toilet from the upper flat, until then the flat owner whose flat,s bathroom or toilet was  leaking  repaing it by his own expenses,but now other  two apartment owners are insisting that henceforth the seepage problem should solved by two aparment holders by equal contribution.The other flat holder is not agreeing with this. His contention is that if one is the sufferer and the fault is of uppar flat  owner then  why other flat owner  should bear 50% expenses and stop this troble of water leakage. 

     What is the legal answer for this?

When you live in a single building, you need to adjust.  You cant run to court to stop seepage.  Gather together and come to a unanimous decision to get the thing fixed.  What good are neighbours for?
