resignation withdrawal

Dear Sir,

I was selected for a General insurance company as A.O. In 2009.

I joined on 17/08/09 and resigned  on 31/08/09 due to some personal problem. My resignation is yet to be accepted. Now  I want to know if I can withdraw my resignation and rejoin the company? company is governed by CDA Rules 1975.

I agree with the views above. However consider a situation where an employee has expressed an intention to leave the employment and requested for waiver notice period. He receives a communication that the resignation is accepted but he would have to serve the notice period. In this situation whether he can withdraw the resignation during the notice period since the resignation would be effective only after completion of the notice period?

It is well settled principle that till the resignation is accepted and communicated to the employee, he/she has right to withdraw the same.

Theoritically you can do so but practically you cannot because you worked only for a period of 13 days and without giving any notice had tendered your resignation which generally is one month. When you didnt are for the rules why that company should do.
