Tdr claim rejected by indian railways

I had booked a ticket from Itarsi to Pune in  GKP PUNE EXPRES  , journey date was 26 January 2014. I was unable to cancel it on night of  25th January 2014 since the train had already departed from its source station Gorakhpur (GKP) and hence was directed by irctc to file TDR .
 
I had Filed TDR Claim mentioning the reason " Passenger did not travelled" within 2 hours of departure of train. Subsequently I had sent an email to tdrprocess@irctc.co.in asking as to when the refund will get processed . I didn't got any response from railways and  today [28th February 2014] I received an email from tdrprocess@irctc.co.in mentioning that claim is rejected  stating reason   "As per chart, passenger has travelled".
 
 
Please note that I had travelled to Kalyan by another train and hence could not travel by the GKP PUNE EXPRES on same day. I have the ticket details of other train also , hence I can prove that railways has wrongly denied the TDR claim.
 
Please advice how to  proceed legally in this matter for getting the refund.

Anything happened after posting your complaint here? Did you get TDR refund?

I appraoched few lawyers however they mentioned that case against IRCTC/Railways can't be filed under consumer court as they have separate tribunal
 
and that there is no specific time line for resolution. 
 
Also the fee of layers is more than the money I lost to railways , so it is not worth it to pay thousands of ruppees to get few hundred bucks.
 
Following up with railways or with any government agency in  india  for that matter  is sheer waste of time,  money and  resources.
 
I have given up . Peace of mind is more important than following with railways. I understand that my case isn't an isolated incident but a general trend.
 
May be railways has found new way to boost their revenues.

Thanks for your reply Chinmay. I am also a victim of the same where I had filed TDR well within the time and as per the rules but the TTE has marked me as travelled in the train and thus railways rejected my TDR. I am just looking for some means to fight for my money without wasting much time and money. I will let you know if I see any success.

Hi Chinmay,

 

I had raised a grievance in pgportal.gov.in and after a followup with the email mentioned of Central Railways (this email ID was updated in my grievance request after it was forwarded to Central Railways), I had got a full refund of my ticket (minus clerkage and irctc charges). You can also try the same approach and give them some time to investigate. If you have any proofs to support your claim, you can send it to the email that will be updated in your grievance request.
