10 yrs Exp= PG

Dears friends,

Whether an Advocate with LLB degree having 10 years or more practicing experience are treated to be equivalant to 'Post Graduate' and they can directly apply for registration in 'Phd.' without LLM? If it is so, where it is written? Is there any judgment on this point?

Kindly note that LL.B Degree with even lifelong experience of practice as Adovcate or any other experience cannot either be equated with or replaced for LLM for the purpose post graduation in Law to be eligible for pursuing the 'Phd'. For registration in Phd., possession of post graduation with minimum 55% marks is a mandatory requirement and I do not think that any judgement in this regard will be needed to prove this fact, except that the of the rules of the Universities \ UGC.

I have also heard as asked by Mr.Vikas Kr. Sinha but I could not get in which Act/Ordinance/GO it has been written. If it is true & in the knowledge any one please inform.

Thanks to all of you for concern,

Mr. Jose has replied according to common law, which is correct in itself.

But I have seen in a local news paper that a case was pending in S.C in this regard,and in that case University was the appellant. That means, in High Court there must be some order, which supports my query.


But the problem is that there was no clue about the name of the parties or year of case in the said News Paper. Therefore, if any body else have heard about such case, please inform, it will diffinately help a lot to the interested person.

The news might be wrong or incorrect, but our research will bring a deffinite result.
