Sir
please tell me if a person is running a steel fabrication work in a house such as making steel almirahs,steel boxes,coolers,and also their painting etc in a residential area and only those peoples are affected whose walls are joined with the concerned house by regular noise of hammering and polluted air with spirit and paints then did the 133 crpc will be applicable or not,if not then what will be the solution for the same.

You will have to file a suit for permanent injunction. It is civil nature case.

May approach court for permanent injection, prey for interim relief also.

Commercial activities especially the manufacturing activities in the residential area definitely pose danger to public tranquility and thus the same is an offence punishable under secion 133 of criminal procedure code hence a complaint is liable to be filed before SDM of the area concerned.
