IS IT NECESSARY TO FILE INCOME TAX IN 138 MATTER REALTED TO CHEQUE TRANSATION BY COMPLAINANT/IF THE COMPLAINANT IS NOT FILE INCOME TAX THEN ACCUSED GOT AQUITTAL OR WHAT?

IS THERE IS ANY JUDGEMENT WHICH SAY EVEN IF COMPLAIANT IS NOT FILE THE INCOME TAX SO WHAT ACCUSED GOT CONVICATION ?

PLS TELL ME SOME CITION IN FAVOUR OF COMPLAINANT?

1) May be query looks academic but may have been posted by a complainant who is not filing IT returns.

2) Some HIGH COURTS have taken the view that not filling IT return is the problem of complainant it will not make the dues illegal.

However if it is cash transaction than doubts can be raised that it was fabricated case.
