(Querist) 29 March 2013 This query is : Resolved 
i am accused for offence u/s 341,506 of ipc .
presently i am in London for job. in my absence by mistake my younger brother took summon of above case after police filled charge sheet in court . i m in London so can not appear before court as such Magistrate issued non bailable warrant (NBW) Against me .
My question is
1- Can i file valkalth nama appointing advocate on behalf of me to appear in court to represent me in absence me ?
2- in this case complaint is ready to compromise matter before court .
3- My fear is that when i appear before court magistrate will send me to jail due to pending of NBW
3- i am coming to India in June how i can compermise matter and recall warrant and compermise matter without going to jail
please suggest

1. No since W/A is issued.
2.When you appear the bail would be granted especially when the complainant is ready to compromise.
Come and go for quashing on mutual consent.

2. This is very good. Even complainant can withdraw his complaint if this is a complaint case but if this is police case then you need to come there.

3. This is possible but there is no other alternate.

4. Surrender before the court and apply for bail in the same application stating therein that you were abroad at the time of issuance of the notice and thus were not aware of the proceeding of the court. Enclose copy of your passport and visa thereon.
