Dear querist, since 498(A) of the IPC is cruelty to a married women by husband or by relative of husband for demand of dowry which is a cognizable, non-bailable offence and continuing offence it has nothing to do with how much your marriage is long. It can be institued even after a long gap of marriage any time. So better to move anticipatory bail u/s 438 of cr.pc. Once the bail is granted half the battle you won.
