498a fir quashing possible

My wife filed a false FIR against me and my father under Sections 498A, 506, and 3/4 of the Dowry Prohibition Act to extort a huge sum of money from me. She has already extorted jewelry from my side. The FIR was registered against me and my father five months ago, and the chargesheet was submitted two months ago, but cognizance has not been taken yet. I have verified this with two advocates. Time is passing, and nothing is moving forward. What should I do? Should I file for FIR quashing on behalf of my father, or should I wait for the chargesheet cognizance, which seems uncertain?

The Magistrate takes cognizance of an offence after filing of charge sheet by police. The cognizance is generally taken immediately after the charge sheet is filed. Sometimes, it may take one or two dates after the filing of the charge sheet.

Did you and other accused receive copy of charge-sheet and your lawyer has argued on the point of framing of charge(s) or discharge ? If so, what is the outcome ? What is the opinion and advise of your lawyer on the facts posted by you.
However, if you are not satisfied with the lawyer engaged by you, it is better to consult another local prudent lawyer for proper analyses of facts, professional advise and necessary proceeding.

Quashing is possible only if the charge report taken as a whole accepted in its entirety does not constitute the offence, as alleged. First of all, get a copy of the Police Report and get it examined by a competent legal professional.

You may wait for the court to take cognizance after which you will be supplied with copy of the charge sheet, you can file quash petition to quash charge sheet.
