. i have a property measuring 23 cent of land in that my house is situated. my house is in panchyat area. West and south side panchyat 3 m road . panchyat now planning to extend 2m more for road construction. i was asked to give 2m from west side for road construction , in this i would be loosing nearly 1 cent from my present title. it is heard that i would not be compensated as this property is in panchyat area. kindly advice. even if my property is taken , i have to build boundary wall of my own expense.

Generally, compensation will be given if panchayat/Govt for the land is taken. You have not mentioned where the property is situated. State rules will apply. So consult a local lawyer for guidance and if necessary to file a case.
You will get compensation if your land is acquired by the govt. Before starting any road work govt. will send notices for acquiring the land and your property will be valued and accordingly compensation will be given.

How do you claim to be owner to the land under acquisition by Panchayat ?
It is better to consult and engage a local prudent lawyer for appreciation of facts and professional advise in your interest.

The panchayat has no legal authority to encroach beyond the boundary line of the property adjacent to its roads but what is being done is people living around exercise muscle power under the leadership of the political functionaries and the land owner will not be able to resist their move.
If the person is strong enough in using legal power or some other sources of power he can resist such encroachment which is unlawful.
Panchayat will give compensation only when they legally acquire the land for road widening after issuing proper notification by the state government. That happens only in large scale projects funded externally.

Querist --First show all the Papers / Documents and discuss with an Local Advocate. If the Land taken up by Panchayat is not yours Legally you have No Right to Make any Objection or Claim as Very Rightly Advised by Advocate Dr.J.C.Vashista Ji

Refer the Orders of Punjab & Haryana High Court (Chandigarh) Bench of Honorable Justice Rajiv Sharma and Justice Harinder Singh Sidhu on Oct 5th 2020." The Honorable Bench had directed that all the Panchayats in the State to Ensure that the Panchayat / Gram Panchayat and Common Lands was Not Encroached Up. If Encroached up on Steps to be taken for Eviction of Illegal/Unauthorized Occupants Immediately the Bench asserted."
