Admissibility of evidence after the case is filed

(Querist) 11 July 2013 This query is : Resolved
Sir / Madam,
We have filed the case in 2005-06 against a person that he is using abused words and threatening to kill. One of the witness died in between the case but still he used to threatening me. We got some evidence which were not available at the time of filing the suit but which are very important. But the Judge dishonored the proof and said that additional proof are not acceptable once the case is filed. So I need your advice that what should I do... what is the procedure to give additional evidences. Please give ref. of case law if any....

Thanking You

Whether you have filed ciivil suit or criminal case?
Dr V. Nageswara Rao (Expert) 12 July 2013
what kind of evidence is this? Documents, witnesses etc?
avdhesh (Querist) 12 July 2013
Criminal case U/s 504, 506(1), 34 of IPC.
And the evidence are video recordings by spy camera and produced in the form of CD, in which a person is using abused words in 2011-12 in front of another person.

In Criminal case filed in 2005-06 evidences of 2011-12 will not help. Fresh case need to be filed on the basis of these evidences.
