Dear Sir/madame,
I am a secretary of coop society in Mumbai.One of the occupant of building tried to encroach upon building compound and has filed numerous bogus complaints n claims against society.The society has not admitted him as a member,now he approached registrar and got order for admitting him as member.Society has not grated him membership and registrar in connivance with this person is taking active interest to admit him as a member.
Pls advise what steps the society should take against such errant occupant?

Dear querist
if the society is registered, filed a suit for permanent injunction before civil court and pray to court to pass an order to restrain him from the society.

Society is free to make further appeal against the illegal order of the register to provide membership to such person who already has encrached upon the common land of the society.

How the Registrar directed you to admit him as member , without hearing the Society??
You Appeal against the Order of Registrar, and prove he is defaulting person, violated society bye-laws, and trying illegal renovation, constructional that may result into declaring illegal construction and demolishing the entire building by local body.
After all he is ilegal occupant.
HE IS NOT EVEN A MEMBER OF SOCIETY.
Also complain to municipality.
Also move court for injunction.

how can a encroacher be admitted as member? he has not purchased any falt . order of registrar can be challenged in appeal

Dear Sirs,
There has been a time lapse in filing of appeal.Also registrar is hell bent on asking us to admit him as member and he says this with lots of authority! He almost forces to implement his orders...
He is gone to the extent of making notes in the register himself ! do such powers exist?
We are intiating process of filing appeal but it may take a week or so.. Pls advise further...
Rgds
