Advice regarding co op housing society matter

Sir,

I am a Secretary of one co op housing society. In our society one flat is on leease basis since last 10 years. Since last 8 years neither owner nor his any relatives visited to this flat. One estate agent to whom the owner had given key of the flat is taking monthly rent and after repeated reminders he has not submitted leave agreement along with NOC from concerned police station.

In this situation what action can Executive Managing Committee of the society take in this matter.

Your valuable advice will be highly appreciated.

issue legal notice to owner of flat . write letter to local police station informing them that inspite of repeated reminders no police verification is done in respect of flat . send copy of such letter to owner .

atleast in Mumbai police are very proactive and they do rounds of various societies and insist on police verification .

Managing committee have wide powers in this respect. If a member is not complying with the direction of the society norms then his share can be got forfeited by providing him opportunity of hearing.
