Ancestral Property

My father owns a wing of his ancestral house along with my paternal uncles. His portion is in his name. My question is can my father sell his portion to an outsider as my uncles are not offering market price for the property?

Dear Anonymous,

The answer is a conditional affirmative for the reason that till date no formal partition of the property has not taken place as such without demarcation of property your father may face difficulty tomorrow hence first he should resort to physical partition of the property and then seek sale of the same.

Yes, your father can sell his share to an outsider but it is better he takes in writing that they are not willing to purchse or offer market price for the same.

The property has been partitioned in 2001 and mutation also done
