Appeal in the bombay high court

Querist : Anonymous (Querist) 17 January 2024 This query is : Resolved
I lost my case in the Pune Civil Court and I have appealed the judgement in the Bombay High Court. I delayed by
196 days, so I need to get a hearing for condonation of delay. I flied my appeal in April 2023 and my high court
lawyer still has not got a date for a hearing. How long does it take to get a hearing?
T. Kalaiselvan, Advocate (Expert) 18 January 2024
Your lawyer should take steps to get it listed in the earliest listing dates.
He can submit a request to the registrar to bring the case on the nearest date of listing

Every High Court has its own procedure in listing the Appeals for hearing. Your advocate alone can provide informed guidance.

Are you seeking any interim relief or stay on the Trial Court Decree? Else, the Appeal would be listed only in the due course.

Thanks for your valuable advice. I spoke to my lawyer. None of the six defendants are contesting my appeal in the high court. They have not engaged lawyers or filed any vakalatnamas. My lawyer as well the high court, sent notices to them, no reply has been received to any of the notices. My lawyer says the High Court has to receive a notice stating that there has been no reply by any defendants to courts notices, before a hearing of my appeal is listed.
