Sir/ madam,
Now I am working in College as Non teaching Staff from last 12 years, and recently I completed LLB from pune universityin 2017 (as regular student, attended lectures in morning session & also do my job full time) , I have a query , I wanted to appear the AIBE examination , is it possible to me to appy for sanad & appear AIBE. without taking sanad i am not fill up the AIBE form .
My query is I just wanted to appear & clear the AIBE examination but not want to practice . I am government employee, and now i am not ready to leave my current job for 5, 6 years. is it possible to take Sanad From Bar Council of Maharashtra & Goa, and appeared for AIBE exam , and after clearing the AIBE examination , to surrender the sanad. ....................Now i want to appear the AIBE examination. ....please reply ...

A Government servant cannot enrol as an Advocate and cannot sit in for AIBE.
Once you leave the employment, then you can enrol as an Advocate and take the AIBE. NOT BEFORE THAT.

Nothing could prohibit you from writing AIBE examination. Once you Pass that Exam you would be eligible to Practice.. Once you receive the Certificate to practice from the Bar Council you should submit a Letter to BCI stating that you are not going to Practice with your valid as Proof of employment.. Enrollment in Bar Council and getting thro AIBE exam is different and you are eligible to complete it even if you are in Government Service Only the Practice in Court will not be Permissible.

While in service you are not eligible to obtain certificate of enrolment from concerned Bar Council.

You could /should Enroll with your Bar council and after Enrollment you should submit a Letter confirming you are not going to Practice as you are in Services and could take acknowledgement. Once you decide to Practice you could submit a Withdrawal of that letter..Enrollment in Bar Council is different and Rendering the services of an Advocate to others/public is different

I challenge.
AIBE Can be written only after enrolment with the Bar Council.
A person who is in employment cannot even enrol with the Bar Council.
It is completely a different matter, that a person who is not in service gets enrolment, but subsequently gets employment. In that case, he can have his enrolment suspended during the period of his employment, and get it revived after leaving his employment.

Dear Querist you should not appear in courts after enrollment in BCI . Enrollment doesn't entitle you to Practice.

Certificate to Practice would be issued by Bar Council only after you get thro in the AIBE Exam

After getting the Certificate to practice you should submit your Letter to Bar Council that you will not appear in Courts to practice since you are an Employee
