Dear Sirs,

In a decree against JD,can EPF and PPF be attached on withdrawl after retirement ? Can Gratuity of an Employee be attached. Kindly enlighten with provisions of law. Thanks

Balance in PPF account cannot be attached under court decree, Another important point is that the amount standing to your credit in the provident fund cannot be attached under any decree or order of any court in respect of any debt or liability. Gratuity payable cannot be attached in execution of any decree or order of any civil, revenue or criminal court, as per section 13 of the Act. But however on withdrawal from the account the same can be attached.

Dear Sirs

If the member dies then it is not attachable from its nominee sec 10(2) of act.Then why should it be attachable if the member is alive & withdraws the EPF/PPF and is able to prove that this is from that a/c on his retirement after 60 years of age.
