authority of the Landlord to stop repair/construction work

(Querist) 12 April 2009 This query is : Resolved
Dear Experts,
We have small room which was purchased in year 1974 in mumbai suburb bhandup on pagdi type sale. no sale deed was made but the landlord was provideing receipt for the rent for the land. since then till date the house is in bad shape and has not been repaired or allowed to repair by the landlord. the landlord is asking for a plum sum for getting it repiared which is almost the cost of purchasing another room. we asked him to get that repaired for which he is not ready.

what is the right ot the landlord in that property after so many years?

for repair permission bmc is asking for noc from the landlord.
What is the remedy? who can help? BMC MP, MLA, Polic station, Court?

Please advise.
regards
SM

You have to approach the Court of Law for remedy.

I am of the View that First you issue a Request lettter in writing to the Owner to attend the repairs , as the same are badly required to the Room/house , other wise the Room/House can not be used. After written reply from the Owner , a decision can be taken.

with regars !

The application to Mumbai Municipal Corp. has been submitted for repairs. The govt has allowed to repair upto 14 feet height
BMC has asked (not officially) to get landlords permission.

We have approached personally to the landlord but he asks for huge sum for the permission.

Please advise

BMC not required you in writing - for permssion of Land Lord as mentioned by you !
you can serve notice on the Land lord to attend the repairs and wait for reasonable time and then proceed with repairs !
