bail

(Querist) 07 February 2011 This query is : Resolved 
One of my neighbour filed a false case against me and the police officer asked me to take bail from court. i took bail from the magistrate court and subsequently they charged the case. now i have received summons from magistate court to be present there on next week.
whether i have to take bail again from the court. or the anticipatery bail will continue

kindly clarify the possition

No need to take bail once again. You can face the case.

YOU MAY CORRECTLY MENTION WHETHER YOU GOT ANTICIPATORY BAIL FROM SESSIONS COURT .THE SAME SHOULD BE VALID TILL FILING THE CHARGESHEET IN THE COURT. IN CASE OFFENCES ARE TRIABLE BY JMFC COURT THEN YOU HAVE TO APPLY FOR REGULAR BAIL AND FURNISH SURETY IN COURT.BUT IN CASE OFFENCES ARE SERIOUS NATURE AND TRIABLE BY COURT OF SESSIONS THEN YOU HAVE TO APPLY FOR BAIL IN THE SEEIONS COURT AND SUBMIT SURETY .GOOD LUCK.
AS YOU HAVE NOT SPECIFICALY MENTIONED THE COURT GRANTING BAIL IT IS ADVISIBLE TO CONTACT YOUR LAWYER WHO APPLIED FOR YOUR BAIL.GOOD LUCK.

as you received the notice to appear from the magistrate's court, it means you have taken the bail and you need not to take any further bail, just appear before the court on the date mentioned therein and received the copy of the chargesheet to proceed with the case.

there is no need to seek bail again....the latest SC judgment says once the AB is granted it will continue for the complete trial.

You are already on bail, now it is not necessary to apply for bail again.

i agree with the experts as per new law no need to get fresh bail but u have to file bail bonds if not furnished earlier

In case of anticipatory bail fresh bail needed after chargesheet if presented and if summon issued after cognizance.

ONCE YOU HAD TAKEN BAIL THEN YOU FACE THE TRIAL.
