In every criminal case if you want to get bail you should be present before the court, but if you are in the custody on behalf of you bail application will be moved in the court. In case of bailable offence bail will be granted immediately.

See. The quarist says in bailable offence ....so there is no question of having the accused in custody at that time so such bail application shall be moved by his pleader in his presence.
