Querist : Anonymous (Querist) 01 July 2023 This query is : Resolved
My brother has been convicted and is in jail. But his appeal in the higher court has been admitted and will come up for hearing next month. In the meantime can he apply for bail and be released from custody.

Along with the appeal he should have filed a bail application simultaneously, he can apply for bail even now as the appeal is pending before high court and the lower court conviction has not be confirmed.

He has filed a appeal in the court , His sentence has been suspended by the lower court for a month. Does he have to appear again after a month at the lower court which sentenced him. His appeal will come up for notice next month

After the completion of one month of suspense of sentence, he should apply for extension based on the pendency of appeal before the appellate court.
