This query is : Resolved
MY friend was granted bail on two sureties of 50,000/- each and a bond of 50,000/- to be signed. He is finding it difficult to find guarantor in that area. If he produces people from his state, it will go for verification. Can he produce two FDs of 50,000/- each, so that there is no verification and he comes out easily??

Yes! he can do so.Court would allow as there can be no better security than one being offered by the accused.

Thanks for the reply Sir. So he will have to deposit two separate FDs of 50,000/- in two different people's account and they will play as guarantor. right?
>Can his real brother become guarantor?
>Should the FD have some maturity?

Well advised by Mr.Prabhakar. Yes his real brother can be guarantator. No Maturity time.

You can do so but for that you need permission of the court to modify the order of condition of bail.

"Let the applicants be released on bail, on furnishing a personal bond of Rs. 50,000/- by each of them and two sureties by each of them, each of the like amount, to the satisfaction of Magistrate concerned"
These are the wordings of the order...
Dear Devajyoti Barman, Does it require any change in the order if FD has to be produced??

Brother and any other relative can also stand as surety.
If the accused is not in custody apply for modification of the bail order, if in custody can give FD receipts and after release of accused can apply for revising of terms of bail.

Brother and near relatives are best surity. Those can definitely be involved. Cash can also be deposited with the court.
