Bank account wrongly debited on the basis of email -funds transfer - to get meoney from bank

dear members,
I have one bank account in a schduled bank in which in nov 2013 bank has tranfered funds debited my account , which i not regualrly operating; it is a od fd account; on the basis of a email . thought the registed email is mine, it is not sent by me and i have never send mails to my bankers. this informaion I came to know in nov 2015 only when my deposits are matured and found the same adjusted against the wrong overdraft adustment.
the bankers not yet replied to my query.
what course I have to take to recover my money.

For fund transfer the bankers will not accept email requests.
The bankers are having general lein on your FD, so, they have every right to adjust it towards your loan, even without your request.

Try to find out who sent the email and who was the beneficiary?
If the transaction was fraudulent, ask the Bank to lodge FIR. If Bank does not do so, you can proceed.

Bank is liable for any fraud in your a/c due to deficiency of the bank/banker.
You may write to BM,Circle Head,Chairman,MD of the bank to supply you the certified copy of the email in question and if there is any suspicion or transgression by bank/banker you may escalate to vigilance cell, RBI and pull the bank to DCDRF as well.

You can file an application before the Adjudicating Officer appointed under Section 46 of Information Technology Act, 2000 claiming breach of reasonable security procedures by the bank.
In case the bank fails to prove that they have maintained reasonable security procedure, the Adjudicating Officer who has the powers of a Civil Court, may order the bank to pay damages as compensation to the victim.
