T. Kalaiselvan, Advocate (Expert) 23 October 2023
Bank manager is empowered to file a money recovery suit agaisnt the defaulter customer, how can you say that the bank manager has no authority.
If you feel that this is abuse of his power then you can challenge the validity of the institution of the suit and also deny the allegations made therein on merits and documentary evidences in yor support

Lenders are allowed to file a case against you and send legal notice to loan defaulter under the Negotiable Instruments Act 1881, Section 138. Moreover, if the lender determines you are a deliberate defaulter, they can proceed with criminal charges under the Indian Penal Code, 1860, Sections 403 and 415 of. IPC

The query is short of material facts. What are the grounds that make you believe that the proceedings have been filed without due authorisation?
