blame by pillion rider

Respected sirs/madams,
while riding motor bike I met with a serious
accident/head injury taken by 108 ambulanc to
hospital.after recovery I came to know that
my pillion rider who was also injured claimed in
MACT & blamed me for rash driving which is totally false.she talked
about involvement of one Tempo in that accident but as per my memory I believe
I got stucked up with something on the road.because of serious injury I couldnot do
FIR that time & also couldnot inform my insurance compamy.what should I do now.pl.
suggest.

Whats' about the chargesheet, on whom it is filed. If it is filed on the tempo driver then the insurance co., of the tempo will pay the compensation to the pillion rider.
If it is on you and if you have paid insurance premium for pillion rider also then your insurance co., is liable to pay the compensation otherwise you will be held likable to pay the compensation.

Sir,
in this situation what should I do now? in the MACT petition copy -in first page ACCUSED
no-1 the tempoo driver,no-2 me & no-3 my insurance co. but at the last/final page only
the tempo driver's name is mentioned as accused.can I file a case against the pillion
rider for blaming me?pl.suggest

You cannot file any case against the pillion rider. You merely counter his case denying any rashness and negligence on your part.
