My cousins mom register her will in name of his son that her property goes to son after her death and my cousin is deceased what benefits his wife and children will get .My cousin sister give her property right in favour of his brother [cousin].Please reply.

which document/deed Required to be Prepared

I have been approached by Goldsmith,to let out my vacant shop, as the shop is vacant and Goldsmith unable to pay much rent, He Requested me to Give my Shop on Seating Capacity basis, by which the Goldsmith will pay me Rent for his seat basis, Total capacity is 10 members, Balance 9 seats i can rent out to members whom i wish to.
Qt 1) What agreements are required?
Qt 2) Do you advice for let out?(i am forced to let out due to paucity of funds)

Property rights

Sir, i was adopted in the year 1970 by my own uncle( Father's brother) since he is not having any issues. At that time out of 45 acres of his ancetreal property he made a partition deed and gave me 10 acres of land in it and put my adopted mother as guardion.At that time the patta and other records were changed in my adopted mother's name.He is enjoying the whole property till his death. he will look after my needs and meet my children's education expenditure also. I am employed in another town and for the last forty years the property was looked by themselves and money given to me when i needs. now my adopted father expired in 2004 without writing any will. Now my adopted mother refuces to give and land to me and occupy all lands and cultivates in it.She says that there is no right on it since all the property were her husband's property and they loookafter the lands for a very long period. now how can i get i) the land given to me by partition in the year 1970 ii) whether i can have any share on my adopted father's property.

Compilation of features - legal issues?

Dear Members,

We would like to Compile (into a BOOK) whole episode

of a selected feature(non-fiction i.e. interviews)

which had been published in a local daily news paper

three years back.

This was authored by a single author.

Is it infringement of copyright?

Do we have to face any delinquencies in this regard?

Please enlighten us in this regard.

Already Put Up Area under section 33(10):

1. Plot situated at village chembur, Ownership-State Gov.of Mah., Zone- R
2. As per P.R.C. Area of Plot =5450 Sq. Mtr.
3. As per Ann. II issued by add. Collector area of plot=1560 Sq. Mtr.
4. LOI granted to this 1560 Sq.Mtr. Plot on 29th October 2010.
5. Total # of slum dwellers as per ann. II =65, Eligible-32(res-20, Comm.-10, res cum comm.-2, consent-31 nos.(96.87%).
6. Complaint filed against bogus irregularities by our society to S.R.A./Collector/ Add. Coll. Where 8 irregularities where confirmed by collector.
7. LOI extension granted or not we did not follow.


1. Ours Sangh Comprising of 54 commercial hutment dwellers surrounding this 1560 sq. mtr. Plot in L shape(which till now is not included in the S.R.A.Scheme).
2. Our Sangh is certified by the Societies Registration Act, 1860 on 24th December 1979 and also registered by Brihanmumbai Dharmaday Ayukt (1950, clause 29) on 29th May 1980.
3. Recently 4 years before we formed a Trust out of our society.


As per now:-
1. Developer is ready to include all these 54 comm. + 12 resd. Structures in the already submitted scheme.
2. Ours 52 members have agreed by signing in our rough minute’s book for 4 of our members who were represented for the discussion with the developer - to be their representative.
3. Developer has agreed for an M.O.U. type understanding which can be registered in the court of law with three members of our society who have taken the undertaking of representativeness.
4. Developer, our comm. Shopkeepers have agreed to go with the rehabilitation project with the below said important points =
a. Each commercial structure will get the same area as per photo pass/usable whichever is larger as per now.
b. Every comm. Structure who will be non-eligible will be made eligible/or compensated with the free sale component.
c. Comm. structure locations will be approximately same as per now existing.
d. Commercial structures possessing larger area will be compensated by free sale component which will be notified in the registered agreements forwarded to S.R.A. .
e. 8 members of the adjoining C.T.S. will be included in the rehabilitation scheme.
f. Any advantages forwarded by the authority will be passed on to all comm. Structures such as height extension as our shops have RCC slabs with ground +1 usable area which were granted by B.M.C. for earlier setback road line.
g. Required documents by S.R.A. such as Consent letter & annexure will be first put up , surveyed , plan prepared shown to comm. Hutment dwellers and the put up for approval with the registered agreements.
h. Rent of the demolishing structures will be decided later after all approval by the concerned authorities are taken by the developer.
I . Structures allotted in the redeveloped building must have approximately the same location of the road as per residing now.
j. As per S.R.A. guidelines new / changes in chief promoter, secretary must be done .



Want from you sir =
1. Understanding/ authorizing letter for the 3 / 4 members given by other members for involving in M.O.U. /similar letter with the developer for welfare of the comm. Structures.
2. M.O.U. or similar letter which can be binding & registered in the court of law.
3. Any other letter which can be binding in the court of law.

Sale of minor's property by guardian/parents

Dear Sir,

I have bought property which was jointly named in 4 family members of which one was minor. I have paid dues in full and sale deed executed by POA by one of the adult member. Can Minor which is now major can challenge the Sale Deed ? What is legal right for buyer who has purchased in good faith.

What is the formalities to be made to avoid such challenge from Minor ?

Written off trade mark expenses

wherein it had been held that the expenditure incurred on the 1st registration of trademarks was allowable as revenue expenditure or capital expenditure ? can this esp written off within 10 year equal installment ? what is the actual practice professional follow ?

legal heir

My name is Mrs. Merchant, im married n have 2 kids, but we r living with my parents in a parsi colony and the flats here in the colony belong to the trust.
Tenants living here are on leave n licence basis.
The flat in which we r living is under litigation since the last 30 years. This litigation started between my father n the trustees. He lost the case in lower court n now have filed appeal. Before final disposal of the entire case, if any one or both my parents r no more, can my husband take over the litigation in his name ? He is Muslim n not parsi.
Do the trustees have the power to remove is from the flat (after my parents) if the litigation is still going on ?
Please advice how do we take over after my parents ?

Change of proprietor details from partnership to proprietorship

Respected Sir/Madam,.

I had applied a trademark under our partnership firm six months back. Now my partner has moved and I want to change the
Proprietor details of Trademark application from Partnership firm to Proprietorship. Can any one please help me as to which form I need to submit and the cost involved.
