Sale of minor's property by guardian/parents

(Querist) 19 June 2014 This query is : Resolved
Dear Sir,

I have bought property which was jointly named in 4 family members of which one was minor. I have paid dues in full and sale deed executed by POA by one of the adult member. Can Minor which is now major can challenge the Sale Deed ? What is legal right for buyer who has purchased in good faith.

What is the formalities to be made to avoid such challenge from Minor ?

Please advise

The sale of minor;s share without court's permission is voidable sale at the option of the minor.
Now you can also apply for permission to regularise the transfer.

Sale of minor share without court permission is voidable.

Get the position regularized by applying permission.

Agreed with the experts. Since minor became major now, additional deed by giving consent of the minor confirming the previous sale by other co-legal heirs and the purported POA holder. Thus the error can be regularized and once this is done, the minor will not have any right nor can he rise any objection later.

I agree with the experts views and opinions on the subject issue, nothing more to add.

It is the desire of the minor which has now become major either to confirm the earlier sale or to reject/rebut it and get it set aside.
