what in mini. limit to pay service tax ? & it is mandatary for all to get registred in excise office for service tax,if income is less than to pay limit . it is compulassary to fill return for all ??who is not come in limit

Tax in case of sale of ancestral agricultural property

I am selling agricultural land which belongs to my grand mother.
Whether the sale amount will be taxable under capital gain tax or any other tax. I have heard that the population of the village in which the said land is situated is less than 4000. This is the information which I have collected from the websites. Also the rule regarding 8 km from the corporation area, whether it is only the municipal corporation or also municipal council.

MAT CREDIT

I HAVE 2 QUESTION
1) WILL SURCHARGE BE APPLICABLE ON MAT?
2) I HAVE MAT TAX LIABILITY OF RS 45009, I HAVE PAID ADVANCE TAX 100000 AND HAVE TDS OF RS 49667 FOR THE YEAR.
NOW CAN I TAKE CREDIT OF (100000+49667)=149667 AGANIST MY MAT LIABILITY AND CLAIM REFUND OF 104658 OR I HAVE TO PAY 45009 AND CAN TAKE REFUND OF 149667 FOR THE YEAR??
RELEVANT CASE LAW IF ANY.

recovery of insurance claim.

Mr x was a partner of a partnership firm in 1974,. it occoured a loss due to fire and lodge a claim to insurance company.latter on firm discontinued its business completely. insurance company met the claim in 2008-09.and pay rs 1800000. now on request of the other partners ins. compan issued the cheque in the name of one of the partners,Mr. X. who will be liable to pay tax Mr. X or the firm?give case law if any.

capital gain

Dear sir,
i have constantly purchased jewllery from 1979 till 2008. I had recently sold my residential flat to buy a new bigger flat and used the proceeds of my flat along with my long term investment in jewellery to pay the total amount. the proceeds of the sale of jewellery were used in paying the amount to the builder in the same year i.e may2009 (sold and purchased) for the purchase of ready to move in flat for my personal use only. will i be taxed for capital gain or get exemption under long term capital gain investments in property for self use of higher consideration.

refund

what is the time set for refund ? if department not do action than what is the course of action , can any penal intrest may be charged for delays ?
