We are exporter and need to pay commission to our overseas agent who is foreigner. Are we liable to deduct the TDS on commission payable to our foreigner agent. If yes at what rate and under what section?

My first question is in case of a lease deed, as per law who shall pay the TDS (lessor OR leasee )?
Clarification : We have executed an agreement where the rent of the building is 15,500 which is for a period of 3 years. The lessor is not ready to pay the tds. What is the option to the lessee ? Will the tds amount will be refunded showing the tds certificate ?
I would appreciate any help on my above queries.

An institute regisered under society,s act and non-profit oriented. Theinstitute owns certain non-moveble assets. The land belongs to Government of India and situated at Hyderabad. Recently Municipal Coropration has served a notice for payment of property tax irrespective of note that the land is owened by Govt of India and in the name of President of India. Are they correct in levying property tax. Please clarify.
I am Govt. employee in the pay band of 9300-34800 with total pay of approx 23000 a month. Recently I have got an arrear of Rs. 116721 for Jan06 - Apr 09 as per the 6PC notification of Central Govt. of India. I have understood the clause 89(1), which on claim, may get me relief on tax.
But I have few small questions:
I have been submitting my House Rent receipt for all the previous financial year i.e. from 2005-06. But Form 16 shows that there is no exemption on account of HRA in the relevant financial year.
On approach, they say since you were not falling in tax bracket in those fys hence, HRA exemption was not considered. Now I may like to know the expert opinion whether I can still claim HRA exemption for the previous years, in which it was not considered or I am bound to pay the additional tax burden of Rs. 3000.
Moreover my savings for the relevant years is also shown incorrect compared to my original submitted documents. There's is plenty difference between my calculated net incomes for the year and employer's calculation for the year. Is there any provision of getting the benefit by application of any provision.
I should be anticipating the expert opinion in this valued forum.

the applicant sold flat on april 2008 for rs 12 lac which was purchased on 2000.01 for rs 5.25 lac now applicant want to invest the amount in new flat and installment starts from april 2009 the amount of flat is 27 lac.will the applicant get deduction or not.the applicant deposited the sale amt of rs 12 lac in his saving account booked a flat on april 2009 and paid installment of same in april 2009 - 100000, jan -2010 - 100000,and will deposit 400000 lac upto mar 2010
