Disciplinary committee

I am advocate of plaintiff. Defendant's advocate produced vakalatnama with false signature and also false documents in the court and false statement in written statement and application of order 7 rule 11. So I disclose all false of defendant's advocate in written replied and pray for proceedings under section 340 crpc for fraud. But honerable judge without any hearing gave order that you making allegation on defendant's advocate is professional misconduct without any following any procedure. Defendant's advocate firstly making false allegations on me but they are giving immunity for that. The order is under challenge in appeal. But disciplinary committee is interfering in sub judice matter. Does making allegation on defendant's advocate for making fraud in the court is professional misconduct. Please help it

Delay in appointment

I have been waitlisted for a job in central government for which another person has received call letter and he is taking extension. He has received call letter in October and resigned his previous job after 40 days from the date of call letter . And he needs to serve 3 months from that date which will lead to 4 months after the date of call letter. My query is that Is there any possibility for me to get that job by moving legally as he is taking more than 3months to join that job??

Recall notice 1

Hi,

My home loan account which was sanctioned in March 2017 from LICHFL. My account was in default since September 2023 as I could not pay the EMI since my mother's treatment for cancer was going on. I received recall notice on 12 Dec 2023 asking to clear the dues. But I have already cleared some of the dues by 6 December 2023. Also received an SMS from the bank that my account is default since November 2023. I intent to pay this amount by 25 December 2023. In my case is the recall notice still valid or do I need to do something more. Please advise.

Post mortem - delay in case closure

I had rented out my 2 BHK flat. Apparently the occupant, who was staying alone died owing to his medical condition, Date of Death 2nd -Dec.

Reported the matter to police, who took his body to mortuary.

Next day body was handed over to next of kin, since his folks were from Jamshedpur and couldn’t reach the day of demise.

Now my flat is locked and keys are with police, who are waiting for post mortem report.

We were told earlier that report would be available within week and they could handover keys to his family who could then take out his stuff.

Following week one of the family members (cousin) followed up with IO, who claimed that he is on leave and will be back by Friday Night and further informed that he will try to complete the formalities over weekend.

Now IO has stopped taking calls nor replying to messages.

If at all when he picks up phone makes one of the other excuse.

We are in fix as neither tenant family, in the absence of post mortem report/ death certificate could initiate formalities at his office/ bank/ insurance nor I am able to take procession of my flat.

Please guide what would be right approach to follow in this regard.
It’s been 16 days and we haven’t received

Setback deviation for a residential property

Hi there! I have a question about my home in Hyderabad, we are constructing our house and we have the ghmc construction permission for g+2 and because of my neighbour he intentionally to stop our construction and due to his personal grudges he approached ghmc and filed a case in high court saying that we did not have permission to construct etc but the fact is that whatever he complained on us everything is wrong except the leaving setback around the house and rest everything whatever he projected is incorrect and now he has more support and influence on ghmc and now ghmc people threatening us by saying they gonna demolish the property just for we didn’t follow the set backs correctly! Kindly please suggest us the options on how to stop the demolish our house and stop ghmc! Many thanks.

Kerala apartment ownership act, 1983

Planning to install Solar System of 10KW in our building. Project cost is around 10Lakh and approved in EGM. Decided by mojoriy owners except me to finance the cost equally by all owners irrespective of the undivided share percentage in common area. We do have 1BHK, 2BHK and 3BHK flats in our building. It is against the law of the land.
Please refer Section 9(10) of The Kerala Apartment Ownership Act, 1984.
Please guide me in this reagrd.

Share certificate not handed over.

Sir,
I have purchased a flat in March 2023. The flat is registered under a housing cooperative society. The Sub Registrar's office has executed and registered the sale deed.
During the above process, I forgot to obtain the share certificate from the seller. Now I am constantly requesting the seller to hand over the share certificate, but he is not responding to my pleas nor answering my calls.
Please advise me as to how to get the share certificate. Whether I can apply to the Housing Cooperative Society or should I go for legal suit against the seller.

Builder asking to sign undertaking against the sale deed

I had booked a flat in under-construction building under MAHA RERA in 2018.The flat should be ready by December 20.Builder has taken extension 3 times to complete the project in 2023. Now he obtained OC (Partial) from concerned authority and asking flat owners to sign undertaking which is against the sale deed.He also asking society formation charges 50000 in cash without valid receipt.Please guide me.

Recovery of amount awarded by consumer forum

After awarding compensation and costs by District Consumer Forum , is there any other way to recover from respondent other than filing execution petition in Consumer Forum.

Proceedings enquiry

Is there any provision to have a non police Enquiry officer regarding a proceedings drawn up a police person???
