Share certificate not handed over.

(Querist) 17 December 2023 This query is : Resolved
Sir,
I have purchased a flat in March 2023. The flat is registered under a housing cooperative society. The Sub Registrar's office has executed and registered the sale deed.
During the above process, I forgot to obtain the share certificate from the seller. Now I am constantly requesting the seller to hand over the share certificate, but he is not responding to my pleas nor answering my calls.
Please advise me as to how to get the share certificate. Whether I can apply to the Housing Cooperative Society or should I go for legal suit against the seller.
Regards
Rajendra

You can request the Housing Society to supply a copy of the share certificate. You issue a legal notice to the seller for not handing over the share certificate.
T. Kalaiselvan, Advocate (Expert) 18 December 2023
The share certificate will be issue afresh on your name by the society. The share certificate held by the vendor becomes infructuous after the sale of the property.
you can issue a legal notice to the seller if he is trying to do any mischief by not answering to your demands or not returning the share certificate to the society.
