What are the procedures to open a Non Profit NGO in India legally? How to legally raise some funds using crowdfunding and other viable methods? Our goal is to spread rational critical thinking among school and college students.

Company active or dormant

A limited company has not filed returns from year 2000. The status in reported as 'active' by ROC. Under what circumstances the company can remain active though the company is actually dormant. No one is even traceable at the company's address.

Why ROC keeps such company as active ?

Appointment of trustees in a trust for csr purpose

I have a query related to creation of trust by a public limited Company and appointing its whole time directors as trustees.

One of the Company proposed to establish a trust for spending it's CSR expenses through a Trust created by that Company.My queries are;

1. Can the Company appoint it's MD and Whole Time directors as sole trustees of that trust?

2.Whether permission of shareholders of the Company is required for creation of Trust?

Esop & defination of permanenet emplyoee

To issue share under ESOP, there is crieria of eligible employee .The word permamanent is mentioned for eligible employee.

i have serached the defination "permamanent " in contect to understand the who is eligible employees.

Is it in contect of companies who is issing esop? or there is standard defination which is required to follow .

Legal course available for SSI in Bankrupt Limited Company

Dear Experts
Request guidance in the following case
A Public Ltd company had placed order on us through a shell company but taken Advance Bank Guarantee in its own name ( No direct involvement of payments also )
The company is declared Bankrupt by RBI and has IRP sitting on it.
100 % tailor made material is ready for last 1 year, out of which 40 % material lifted after payment and adjustment of advance to that tune.
We filed claim with IRP but was rejected on grounds of not being a registered vendor of company.
The company is forcing us to extend BG every three months and pressuring us to withdraw case of claim against shell company and on giving in writing that we will not file a claim, they will take the material to the extend of balance advance amount and return BG.
This is in knowledge of IRP personal in charge now, who says that they cannot interfere and neither give assurance of non encashment of BG.
What is the remedy available for us, a SSI unit, whose 50 % money is lying dead and are incurring BG extension charges ?

Negligence of hr deptt. erring less salary in my a/c.

hello sir/mam I was working in a telecom sector as a marketing executive from june 2017. i resigned from the post on 9th nov 2017 and in between i took leave on 3rd 4th and 5th of nov which was a paid leave. But the Hr department has given me salary of only last working 5days instead of 8 working days. when i contacted to HR manager he has different explanations, sometimes he says you resigned on 6th nov, sometimes he says that you took holidays , some times he says you were absent for three days and has different versions of explanations.I have proof of my attendance of last 8 working days. I have mailed to senior HR manager and tried to contact him through whats App but he did not replied. I want to file a RTI. Tell me what to do as Those money are my hard earned and i don't want to loose them.

I want to open an institute by which I can also provide various courses with certificates like PG Diploma certificate and normal certificate which is approved by the government as well.

An advice on law

Dear All,
I have finished my BCOM MBA in Finance & I would like to persue a law course to practice as an advocate.
1. Can someone tell me if there are any exceptions in papers as I have done my Mba (PG).
2. Is there any 2 years law course to practice as an advocate ?
3. is it better to do BL or LLB ?

Banking services by an individual

Dear Experts,

I have an curiosity in mind that can an individual start banking business i.e. accepting deposits and advancing loans on interest. If yes, than what are the legal requirements and which law applicable. Further, if GST is applicable on such service and registration for the same is required under GST or not.
