Election duty

I am a senior PSU officer. (Manager in a mini ratna central Govt PSU). My grade is E-5 whereas highest grade is E-8. My pay scale is Rs. 36600-3%-62000 (IDA).I have several times been called for election duty of both Assembly elections & Parliamentary elections. At each occasion, I have been deputed as Micro Observar so far. I have seen that some of my colleagues who are senior PSU officers have been assigned the duty of Presiding Officer whereas their Sector Magistrate from State/Central Govt were of lower pay scale/rank. So far I have not seen that any PSU officer has ever been deputed as Sector Magistrate.[what's election commission 's guidelines] Now I have been again called for duty of Panchayat Election duty and this time I have been deputed as Presiding Officer. I want to know:
1) Can a PSU officer be deputed for State Panchayat Election duty?
2) Can a PSU officer of higher scale than the scale of State Govt./Central Govt. Officer, who has been deputed as Sector Magistrate, be deputed as Presiding Officer? OR can a PSU officer of my rank/grade be deputed as Presiding Officer?
3) How will we compare the pay-scale of a PSU officer (IDA scale) with a State/Central Govt. scale?
4) How to determine whether the pay scale of a PSU employee is higher/lower than a State/Central Govt Employee?
Matter is urgent. legal advice from experts is genuinely requested.
Regards to all.

Right to education

First of all thank you very much. Yes Sir, I faced this problem first hand. My daughter passed the Xth SSLC examination securing 437 out of 500 marks(87.4%). She was denied her choice of group of study. Likewise so many students were denied their choice of group. I have seen so many heartbroken children and their desperate parents running around schools. Some schools even fixed 480 out of 500 as the cut off mark and my daughter’s school fixed 450 as the cut off mark. I dont know on what authority these schools fix their own cut off marks to filter out their students. So that new students are rapidly taken in giving their choice of group collecting donation irrespective the marks. Only later when i examined i learnt about the education act and the insertion of the article 21a in the constitution. All those are helpful for student of age between 6 and 14. What protection the law gives to those minor students who wish to continue to higher secondary is my query.

Nativity domicile & telengana

My daughter was denied the CAP quota she richly deserved. It took one indoctrinated Director of AP Sainik Welfare to issue a Memo asking the ZSWOs not to issue CAP cert to ESMs belonging to the other states. It was more damaging than the mono-logue of Raj Thakre of MNS for cancelling licence of Biharies auto drivers. But none protested.ZSWO Ranga Reddy did what his boss asked him to do. He sealed my daughter's chance to get a MBBS seat in one of the govt medical college in Hyderabad as she was high in the order of EAMCET 2013 rank.
Now whole of Telengana is figting tooth and nail on the issue of NATIVITY issue. It is going to initiate another bloody war.
I request the experts to define NATIVITY as well as DOMICILE of the state of Telengana once for all..Too many diametrically opposite views without any supporting documents may not help. Over to you.

Permanent address issue in tatkal passports

I am staying from last 4 years in a rented accommodation in Ghaziabad and I and my parents do not have a permanent house as we have sold our house 7 years ago. I got a tatkal passport 2 years ago, Now passport office has sent me a notice for adverse police verification that I have mentioned a rented house as a permanent address and they fare frightening me by saying that they will cancel it. But this sounds too illogical as many people will be there who does not own a house. Permanent address is the mandatory item in passport form which I filled as my current address. What is the law or definition of permanent address in India? Please help. I am in urgent need.

Writ for mandamus against order of cg state information commission

I filed a request u/s 6 of RTI Act for information related to self disclosure of information by PIO, District collectoarte janjgir.

PIO did not replied within 30 days of the stipuated time limit aggrived by the same, i prefered first appeal u/s 19(1) of RTI Act before FAA, District collectoarte janjgir.

FAA just sent information for first appeal hearing after the hearing. no further order sheet or any information received by PIO or FAA, District collectoarte janjgir.

Agrived by the inaction of the First Appellate Authority i prefered second appeal before the CG SIC, raipur u/s 19(3) of RTI Act, through speed post.

CG SIC was not registering my second appeal u/s 19(3) so i applied to PIO, CG SIC, raipur for status of my appeal and then they considered my second appeal and registered it which was acknoledge by me through the phone to PS of state information commissioner that my case i now registered.

On the date of hearing i sent written argument for my second apppeal.

To my surprise when i gone through the order sheet of the second appeal i found that SIC has dismissed my case and mentioned in order sheet that the appellant has confirmed through phone that he has received the reply of rti from SIC and his case is registered now so we are dismissing the same.

I want to lodge a writ in HIgh Court kindly guide

Public charitable trust

Hi,

One of the public trust has been created in the year 2001 by two trustees. Now one of the trustee is dead.

The other trustee is not interested in running the trust. Can he convert it as private trust??or can he dissolute??

What is the treatment for assets of such trusts?

If so, what is the procedure.
