Real meaning of award

The final version of Award passed by CGIT as under-

"Award is given in favour of the workman Shri G.P.Gupta. He be deemed to be Telex Operator from 18.8.84 and entitled to allowance of this post. The arrears be paid to workman in 3 months time from publication of Award. The workman will be entitled to an interest of 12% per annum on this amount, if it is not paid to workman 3 months after the publication of this Award,. Management to pay Rs.2000/- as cost to the workman."

My query is that if award is not implemented in 3 months time from publication of award from which date interest is payable

Status of civil and piece rated workers

what is the status of civil & piece rated workers in a factory. Are they covered under contract labour act. If not under what law they are covered?

Pay protection policy of punjab govt

Dear Sir,
I wish to know about the policy of Punjab Govt on pay protection. I am about to retire from IAF on 31st Oct 2011 after 21Years and 02 Months of service. My pay scale is 9300-34800 with Grade Pay of Rs 4200. I wish to know whether I would get pay protection if got selected in Punjab Govt job after proper the selection process. I am attaching a file for your kind perusal through which I have applied for the clerical post. The conditions of the jobs are not clear to me in the wake of ignorance of policies on pay protection as envisaged by Punjab Govt or directed by respected courts.

Please advise me.

Salary, bonus and other emoluments

Dear Sir,


I have worked in one of the Pvt. Ltd., company for 1 1/2 years. I got relieved relieved after given a 25 days prior notice to the company. I got relieved on 4th of Aug'11. The same day my salary has been credited through ECS for the month of Jul'11.

I have asked for full and final settlement to the MD. But he is not given any answer. Company has given "fare Well Party" to me on 05-Aug-11, all the department heads are attended to that meeting. At none of the above times they have not informed me regarding "No Due Certificate"

But they have not settled my Bonus, EPF, Salary for 4days, Incentive for the month of Jul'11 and Leave encashment. I given a first mail on 05-Sep-11 and after i sent 5 reminder mail, They are responded for 5th mail and they said that they need "No Due Certificate" from all the dept. and branch heads.


If I ask "No Due Certificate" now, the company people may manipulate the a/cs and DMS too. Kindly suggest me how can i get the above amounts.

Reg. salary deviation

sir,
please advise me in this reg.

Due to lack of faculty in govt polytechnics, andhra pradesh. Department of technical education, AP. Has appointed lecturers on contractual basis in all the polytechnics with a consolidated amount of salary Rs.10,000/- per month in general polytechnic and Rs.11,000/- per month in (GMR) govt model residential polytechnic (6 polytechnics in total state). For the academic year 2009-2010.
I was appointed in GMRP madanapalle, for the salary of Rs.11,000/- in the middle of the academic year due to budget problem (not allocation of budget to our college) we (13 contract members from our college) were transfered to various(3) general polytechnics and deputed to same polytechnic, by the commissionerate of technical education AP. Only to give salaries on proper time to us. But they forgot that the salary deviation is there. In this regard we have lost Rs.1,000/- per month. This we have informed to our higher afficial's but they are not responding up to level.
One among the three polytechnics principal gave salaries by Rs.11,000/- per month. Where as other two polytechnics principals are told that "as you have transfered to our polytechnic we will give salary as per our college norms only"

Manpower consultancy registration procedures

Respected Sir,
I am Mr. Kartick Roy from Andaman & Nicobar Islands professionally I am an aircraft maintenance engineer and aeronautical engineer working in an airline in abroad. I have good finance and I want to start a manpower/HR/ job consultancy firm (proprietorship) in Port Blair (capital of Andaman) for recruiting candidates from India (all parts) to foreign companies (mainly) and also in Indian companies in all sectors and all levels. In this regard I need some advices and suggestions from law experts.
1. How shall I start the manpower consultancy?
2. What are the legal procedures of registration and start?
3. Give me the detail guideline and outline for start.
4. From where and how shall I obtain different licenses require for the running of the consultancy?
5. Any other valuable information necessary for the starting consultancy business.

Dear All,

Request you to clarify on the following areas.

1.Whether the Contract Labour (Regulation and Abolition) Act, 1970 is applicable to building and other construction activities – eg, Road laying, bridge construction, culvert construction etc.?

2. Under BOCW act who has to obtain registration? Principal Employer or sub-contractors and sub-contractors.

3.Is it a right procedure obtaining labour license under Contract Labour Act for the Construction sites, Road Project where contract employees are employed which falls under the provision of BOCW act?

Age for claiming as senior citizan for early hearing in bomabay high court

I need a copy of the circular issued by Honorable Bombay High Court regarding fixing age limit for senior citizens for early hearing .I understand that with the consent of all the high court judges ,in 1999 a circular was issued by Honorable Chief Justice to fix 65 years for senior citizens for early hearing in the pending matters.
Pl help me.
