Non payment of wages.

whether a managing director of a public sector corpration which wholly owned by a state in terms of share capital, can deny salary to employees on the ground of financial constraints of the corporation.

further, is there any law which bans employer too from drawing salary himself when he is denying salaries to employees over the issue of financial constraints, please provide in case any judgement has been passed in this reference.

Employes Pension Scheme1995(16th.Nov.1995)

Sir,
A person retired from Jila Sahkari Bank, Gwalior on 30/9/2001 as Branch Manager and was getting Rs.13157/-pm on the retirement date.PPO.NO.4902 was issued by Provident Fund Commissioner Gwalior and a monthly pension of Rs.212/-(two hundred twelve) only was sanctioned.An Application was filed before The District Consumer Forum, Gwalior.The date of birth was recorded in the fund office-20/2/1934 instead of 20/9/1941.
Case No,78/05 was decided on 22/11/2005 and was ordered that the Non.Applicant should correct date of birtha and issue fresh ammended PPO.with in one month.But N/A did not comply and a case of Comtempt of court is pending before the District Consumer Forum Gwalior.
The Applicant comply with-Para 12(1)9,2(12),2(11)11(1),11(3),2(13),12(2),3(B)3,3(C)12(5)12(A)
Joined-30'9'1959,Rtd-30/9/2001,LPC-13157/-Membership-25/2/1976,Contribution on Full salary.Pl.See Comments of MrPrabhaker Sinha TIO 27/7/2005
Under Emplotees Pension Scheme 1995 the Applicant is entiled of Rs,6649/pm.while PFC has fixed at only 212/pm.
Please justify and calculate the correct pension.

labour laws

in today's Amar Ujala daily news paper there was a news referring a recent Supreme Court decision in which Hon'ble court has ruled that a loss making employer cannot deny wages hike to its employees.
the case has reference to Haryana State Minor Irrigation Tubewell Corporation.Verdict has been given by Justice R V Ravindran and Justice Lokeshwar Singh Panta revertibg the Decision of Haryana and Puajab High Court.
Can I get the details of this judgement.

LEAVE ENCASHMENT

Sir,

As per our company leave policy-2005. the ELs accumlation is 60 days. The above leaves will be encashble. This practice is continued upto 2007. Now new HOD has come he said that there is no law for enchshment of ELs in the middle of the service. So our employees leaves are crossed more than 60 days (nearly some are 120 days like that) So is there any enactment for encashment of leaves ? If so please supply immediately.

sir,

please let me know that i am working in company my designation is executive grade E3,
which is less than supervisior level, i am terminated from the service without any reason, i have filed a petition under labout commissioner office, and management is objecting that i wont came under this concern.

i have not got any authorisation for signing anything nor i have got any power please let me know and confirm me whether i eligible in this concern.

Fired by employer

In case the employee is asked by his employer to leave the job within 1 day, is there any legal way to counter that.

To be more specific, in case the appointment letter says that the person can be removed by giving one months salary and the employee is removed in the same way without any fault of his.

I am woking in a construction industry. Construction industry is still unorganised. Could you please throw light on the leave policies that are applicable in construction industry. If I am not wrong, construction industry is also registered under companies act.
