We need a draft MOU between two companies X and Y for the following -
1) X is doing a business of Mechanical works in Industrial Construction Projects
2) Y is doing a business of Civil works in Industrial Construction Projects
Now, X & Y would like to have the understanding for -
a) to work together where both Mechanical and Civil works are to be executed combinedly &
b) where civil works are only to be executed, Y shall execute the works under X.
In both the case, X would be a Prime/Lead Bidder and Contract will be bagged in the name of X.

Divorce

Three years ago, my friend's daughter was enticed to marry a person. She was threatened and forcibly married. She was tortured mentally and physically by hi and his mother. She was not allowed to worship god. She was not allowed to continue her education. She was not allowed to fetch a job. She was living under threat. When things worsened, she left his house about 2 years. No cohabitation from that time. Though she could file DV complaint, she did not on advise by her father. Now she wants divorce. He is not consenting. No documents or evidence on her behalf.

What best she can do? Can she succeed?

Blackmail

Hai, this query is related to my friend. She stays in Bangalore with her family of mom, dad and younger brother. Her age is 23 and student perusing MCA. She was in relationship with a guy for about 5 years and got broke up with him a year back. He even owns a criminal record where in he been to jail and court issues, case was murder attempt. He also had many other relationships with several other girls, he used to take all the scholarship amount which she used to get from college and also used to adjust money for him from house which her parents used to give her. Knowing the fact that he was using her interms of money and was a trap laid by him She broke up with him. And she is all normal and happy with her routines.

Now that she is no more in relationship with that guy, he messages her and her mom asking for the ring which he gifted her on some occasion. The same rings were actual kept with pawn store and the amount was taken by him for his personal use. Now he is blackmailing for amount or ring! If they don't he says he will tell everything with her father and he also carries pics and clippings which were taken long back.

Her father Is a heart patient and he is in a critical situation, he may hardly live for another 1 year. Regular checkups and hospital visits happen on a weekly basis.

Knowing the fact that mom and daughter can't do anything in this situation, he is taking advantage and blackmailing them. I have suggested them not to give money at this point of time, because if they do it will become an habit for him to grab money.

I stay in hyderabad hence I am not able to help my friend who stays in banglore completely. Can any action be taken without letting her father know to teach that bugger a lesson and solve the issue once for and all.

Kindly guide me a through a correct channel so that I can walk them in a correct path, as blackmailer holds a criminal record and he is blackmailing both the ladies one is a student and other housewife who have no clue on what to do. He could even attack or harass them. I am looking for a correct procedure so that he doesn't harm them in any ways.

Thank you.

Partition and share

my client is one of the legal heirs of the deceased. Now she has filed a partition suit claiming her share in the ancestral property, but her brother has sold the property long back, the purchasers also parties to the suit. These purchasers have filed a written statement stating that long back suit property is sold to them and without seeking the declaration suit is not maintainable and plaintiff has no locus standing to file this suit.
According to me the person who sold the property has no right to sell entire property, he could have sold his share only. So suit is maintainable and plaintiff has got share.
Let me know your opinion learned members and if any ruling let me know.
Thanks

Instead of filing appeal from order, whether writ petition is also remedy for setting aside order of

Respected Experts,
Complaint structure was partly demolished by the BMC on my complaint. Part of Complaint structure was reconstructed. Again I made complaints to BMC and BMC issued Notice under section 488 of MMC Act to the offender of illegal Complaint structure, then the offender /Plaintiff filed suit against BMC and stayed action of demolition without my knowledge. I filed Chamber Summons for adding me as party in the Suit. On 15.02.2016 the Hon'ble Court allowed my Chamber summons directing the Plaintiff to amend my name in the Suit and N/M within two weeks and at the same time Advocate for Plaintiff prayed for stay of the order stating Plaintiff filing Appeal from Order. Therefore the Hon'ble Court stayed it’s Order (directing to amend my name) for two weeks.
Within two weeks or till date the Plaintiff not filed any Appeal from Order as already prayed before the Hon'ble Court but it is found that on 29.02.2016 Plaintiff instead of filing Appeal from Order filed Writ Petition before the Hon'ble Bombay High Court against BMC and me.
Kindly advise me can Plaintiff obtain setting aside order of civil Court (directing to amend my name in Suit) by way of Writ Petition instead of filing Appeal from Order. At this stage my name is not amended within two weeks nor did Plaintiff file Appeal from Order within two weeks. Kindly inform me what exact procedure.
Thanks.
