Counter claim on partition suit

Dear experts,

My brother files a partition suit before the court and he went to USA and staying there only till the date.

For the same suit, i have filed a reply, in that reply we requested the court for counter claim and paid court fee, and mentioned that we are also seeking the partition.

Now trails will start soon, and court will call my brother but he is not able to attend the court as he is staying in US, if this is the case, will the court dismiss the partition suit? or still court continues the trails as per my counter claim?
is that counter claim will help to partition the property in this case? or any other steps do i need to take to continue the partition suit till i get my partition?

Please suggest me.

Divorce

Currently
She has made hi demands in Mediation which i cannot afford to pay. so the Mediation report is saying mediation failed.

I am supposed to file my objections., I am putting her adultery as the cause of break in the marriage.
Have a flat which is jointly registered, she had paid about 5% of the total investment.
1. Can I petition for the release of property if i am ready to pay her part of investment. any judgements that could help me in this regards.
2. I have also filed 497 against the adulterer and its in the summons stage. (I have photos and vdos of their act in his residence and hotels.)
3. Can i request for divorce proceedings be stopped until the 497 case is resolved. how long would a 497 case go on ?
4. Currently my daughter is under my custody and she has got visitation.,

respected Expert

police presented chalan final report and make me accused under 498A 406 323 and after reading final report i come to know that the Investigation officer falsely implicated me by hide the fact and evidence deposited by me i.e. Photograf of each day, call history of my wife number , call history of my number and SMS conversation, what option me have can the that matter can investigated by other district police or what other legal remedy me have at this stage

How remove partly stay on my property

Sir my father had bought 80.sq.meter plot in gandi village on 26.6.1991 after few years he built a house and we all family members have started to living there in 1999 my father died and after 7 years i got problem from house due to old construction that's why I had demolished whole construction and start new house construction for that I have grant housing loan i have submitted all documents of property like 7/12 entry which is mentioned my name and my mom's name on his property ,property card ,panchayat approved lay out plan as well as construction permition of 1991,then one of my neighbor file case on me that I am constructing house on open common plot in court i have produce document of my property of above i mentioned and and others neighbors house panchayat records who live beside me in same plot in the court the applicant produce land record drawing plan which mentioned on our plot is open space but strangly his sale did there is no indication that this property is common plot finally court ordered partly stay to stop construction ...Now i Have appeal to upper court with additional proof like my electricity's bill voter id card ,my house text bill payment and sitysurvay superintendent drawing. In this drawing there is no open space ...So what is the merit of my case ...I can hope to win...

Land ownership

Sir,

I have purchased 20 decimal of land in the year 1976 in Ranchi district of Jharkhand state. till the date all legal document i.e. mutation and land reciept is with me uptodate. Now last week one person has approched me by stating that my grandfather has sold you in wrong way . i.e. he sold more land that he has right to sale. now he want money from me. i.e. after 41 years of registry . as my dead show agreed signature by all the parties i.e. all brothers of seller.

what to do right now .

Divorce

I'm separated from my husband since 2009 the case is of absconding and desertion. I have a kid who is now 8yrs old n till now everything is just done by me for my son.
I stay in pune with my parents n the guy stays in Andhra pradesh. Due to no proper guidance and support I cudnt file any strong case against him. Had filed dvcc and 498a four years back in Andhra pradesh. Attended the court for 3.5 yrs n now left becoz I'm not able to travel as different state. As of now the case is dismissed.
I want to get divorced. I tried a lot for mutual but they don't agree n not even come to talk. Plus as Streedhan my parents gave me money which they r not giving me.
Experts please advice me how do I get divorce n my money back ( it's in form of fd). I heard that if separation is for 7yrs then divorce easy n not much hasty. I'm very much tired attending the court. Want to get out of this ASAP. Kindly advice me the best thing I can do.

joint holding of flat in coop housing society

My deceased aunts husband and my mother are joint holders of flat in society in 50:50 basis. Joint nomination is filed declaring each one his nominee and percentage share. Is this nomination valid. My mother and me are not in talking ters with my aunts husband. He is first named joint holder while my mother is second named joint holder. Share certificate is held by him. I dont have share cetificate copy. Can i ask socity for separate share certificate of my mothers holding as second joint holder or duplicate share certificate for my mother. Can he refuse signing NOC for gift deed by mother to her only son thats me. If he refuses what is remedy.

Trademark

Sir my father is doing business from 2001 and last year I applied for trademark kanha and I got but now kaanha Bakers sagar send me leagal notice that he had registered his kaanha and I should change my kanha he had start his shop from 2008 and he registered kaanha now wht should I do and also defence in my trademark is kanha and his is kaanha wht should I do?

Joint property - couples

Hello experts

we recently purchased a land as a 50:50 joint ownership between me and husband.

The land is purchased via home loan and our salary income, after validation from the bank for requirements.

Before purchasing this property, my husband wanted an opinion from his auditor and i went along with.

The auditor after hearing the plan to buy the property as joint between us (couples) stated very casually that there might be "legal heir" problems in future.

My husband did not react to this, we discussed few other queries on wealth tax and proceeded to lawyer for legality verification of property papers and completed the purchase.

Question :
We are recently married (2 yrs) and have no kids until now. Since this is a joint ownership property, "what & how" does the legal heir problem mean to us.
Also this is self acquired , we are paying the home loan back through our income.

Since we are couples, Legal heir is only the children we will have, so what does this statement from auditor really means ?

Is there something i am overlooking to the auditor's statement in this context.

fake documents

Sir,
In my city there is a Builder who sell a whole flats in a building to customers.
He use a fake commencement certificate of CIDCo and others document and register .
Flat purchasers fear to fir . I am a social worker and they contact me and said these thing. Can i file a case on builder ?
Please suggest.
