Cross examination

Dear Sirs,

Can I submit the list of questions before I start cross examination to the Hon'ble Judge / Court, that I have prepared for cross examination for divorce case. If yes, should I submit the questions on the day of cross examination or submit the list of questions vide a memo and continue cross examination.

possession of property

AT present i stay with my mother at one home. it is in possession of me and my mother.

This property is in the name of My mother and brother.

I want to prove that this property is in our possession not in my brother, so how it is prove in court ?

chances of bail from session court

my brother is charged with forgery case related to fake document which he didnt made for a passport , he gave money to make passport to agent , the agent made some fake document and submited , at the time of police enquiry my brother came to know the document was fake and police registerd case against him, in sec 420.419.467, now he is arrested and in judiciol custody from last 10 days , we had convinced police and they made statement as we want, even in panchnama they didnt find anything like that report they made, our bail was not accepted in magistrate court as they were not empowered to give bail, i need your advise on this situation , my brother will get bail from session court in first hearing ? what are the chances.
one more point the agent who is also accused is dead. and his dead certificate is submited to police
my lawyer said he 100% sure of getting bail from session court in first hearing.
the public procecutor is also in our side,

Is CAT order operational if WP is filed in HC but stay not granted?

I had filed an Original Application in service matter against Union of India and others in Central Administrative Tribunal (CAT) Chandigarh bench which was decided in my favour in Apr 2009.
Order was received on 20 Jul 2009. The order was to be implemented within two months.
The department requested for additional time for implementation of order and were granted two months additional time on 30 Sep 2009.
Instead of implementing the order, the department filed a writ petition in High Court Jammu on 3 Dec 2009.
Till date the High Court has not granted any stay on the operation of the CAT order and the matter is at admission stage.
Department is not implementing the order of CAT on the plea that the matter is subjudice.
In the light of the above facts, the following points may be clarified:-
(a) Whether the Order of CAT is operative or not?
(b) Can a Contempt Petition be filed pending decision on admission of the case by the High Court?
(c) Is the final decision on Writ Petition to be produced before Contempt Proceedings can be instituted?
(d) Is there a period of limitation for filing Contempt Petition in this case?

who will be the accused in the 138 ni act case

Respected All,

i have one doubt please suggest, my company supplied labels to courier service provider they paid by cheque which was dishonored as they close there account now ,i sent the demand notice to 1) company name, 2)person who placed order on mail.address of the above both notice are same but i sent the two notices.
we are not aware of the real owner of the courier services provider.I recieved the acknowledgemet of the notice which was sent by company name but not recieved the notice which i sent to the person.please suggest who will be the accused in such a situtaion if i file a complaint under 138 of NI act please suggest and can i file a complain?

liability of principal

Esteemed experts,
I am working in a state govt. company. I was supervising a civil work done by a contract labourer. He did a damage while bull dozing. I am proceeded against departmentally. They are trying to recover damage worth Rs.40 lakhs. They are not taking any action against contractor or labourer.
Pl. guide me whether the parincipal/ contractor is liable for the acts of his agent or not.

In a corruption case if the sanctioning authority has not sanctioned the request for prosecution and an authority below the sanctioning authority has sanctioned the sanction for prosecution then where does the case of accused stand . Is the sanction valid ?" are there any judgements ? please help

When should a contractor should apply for contract labour licence..?
When should a Principal employer should apply for licence

Is it possible to apply for licence after lending a contract within a reasonable time say 3 months.
