Section 138, 141 of the negotiable instruments act

Dear Sir/Madam,

I have a query that i was a employee in the company as a Company Secretary and i worked there one and half years. As a Company Secretary i was only responsible to perform the task related with Companies Act and they have assigned to me the same. I left my job in June 2016 but after a year i have received a summon against me regarding dishonored of cheque. The Petitioner has filed case against the Company, all the director and CS of the company and also filed relief sought from all the accused including CS.

During my tenure, the company has not appointed me as authorised signatory to sign the cheque of any bank and i have not signed any cheque in my tenure. i was just an employee of the company not a director.

So my question are:-

1. can the petitioner legally filed case against me?
2. I have to withdraw my name from the case. How?

I request you to please advice me in this case with the judgement.

Unsecured loan

i am an exservice man lended a total of Rs. 15 Lac to two businessmen Rs. 5Lac and Rs. 10 Lac each @1.75% PM in instalments of Rs. 1Lac, Rs 50000 & 2 Lac as & when i could spare money out of my savings in last 5 -6 years by cheques. They were paying intrest in cash regularly every month but now since 2 years neither they are paying intrest nor returning principal amount even after asking many time through middle man and directly.Now they said no money & i can do whatever I like. Pls advise me what I can do or what are my legal rights. Some one informed me that as I donot have any lender license i cannot lend money to anyone on intrest. and it is crime, even court can penalise me with fine and jail for it under anti money lending act. i donot have any loan proof or loan agreement with them other than my cheques credit in their firm accounts. Pls advise me where i can approach for help or should i forget about my money. I am very much worried as my daughter is also getting of marriageable age. Kindlly reply as early as possible. Dv maintanace

Respected experts, Maintenance allotted in dv case for me and my son 2 months back. Respondent is neither paying maintenance regularly nor clearing arrears. My council told we can not pressurize respondent to pay just by u/s 20 of Dv act and so he is telling me to file another case u/s 30. My query- Is it necessary to file that case and will that be helpful for me to get regular maintenance?
