I have filed case for the partition, injunction and declaration, while meantime i had applied for the amendment of the plaint for include the property after filling my written statement. the said application for the amendment has rejected by the trial court,now i would like to file writ petition against the impugned order. how can i prove the "due dilignece" as per order 6 Rule 17, please guide me, its very urgent.

In respect of ancestra proerty devolution by will and partition. What is the effect of the got married and made partition after and before amendment carried out 2005.

further i want to know that can coparcener devolve his share in the property without partition and without consent of the other coparcener by will(testamentary)
and if A left his legal heirs W-widow, S1 and S2-two sons and D- one daughter,
will they get same share?
Whethere D daughter get equal share to the both her brother S1 and S2 ?
Whethere D, S1 and S2 get equal share individualy?
when all the properties are ancestral property.
If A made WILL of the 1/2 property then how does the property devolve.
Is it valid will?

My Father has purchased a 5000 Sq Feet of Land in pune using Agreement to sale (Sathe Khat). This was done 10 years back.
The owner of the plot has died few years back. I am having a orginal Sathe Khat and Index paper with Me.
No Body is occupying the plot at present.
How to proceed to get legal ownership of the Plot.

execution
the suit for partition and injunction filed and same is decreed bythe lower court, the same decree has upheld by Hon'ble Apex Court.
In the said suit adoption deed was challenged, but it was registered so it was held legal and executable. Now i have filed second suit in respect of the same matter in which i have contested that the decree passed and upheld by the Apex court on the adoption deed and same is made by fraud.
now execution of the Apex court order is simulteniouly going on and the hearing of new case also.
so my question is that:
1. can i stay the execution if yes then how and pls refer any case law?
2. can i contest in the execution proceeding that the some property included in the decree is not joint family property?
3. can i offer payment for their share of the property whhich partted in favour of decree holder?
pls answer its very urgent.
