Difference of benefits under proprietorship partnership & pvt ltd firm

Respected Sir,

With the above stated subject, I want to know tax benefit and other related any differences in Proprietorship Firm, Partner Ship Firm or Private Limited Firm.

Work of Firm is Legal Advisor & Consulting of PF ESIC and Labour related works.

Its urgent for me so please guide accordingly at earliest.

Epfo circular 30.11.2012

Dear Members,

As per the circular dated November 30, 2012, was issued after internal review meetings held in late November and has beenforwarded to Employee Provident Fund offices across India. Historically, most companies have been computing provident fund (PF) contributions (at 12% each by the employer and employee) against basic salary and dearness allowance only. However, the definition of basic wages has been a contentious issue, with PF authorities claiming that companies split the basic wages into various allowances to reduce the quantum of PF contributions.
The circular deals with this “splitting up” practice adopted by employers. It states that basic wages will include all allowances which are “ordinarily, necessarily and uniformly” paid to the employees. Thus, various allowances such as conveyance, educational allowance, medical allowance, etc., will have to be taken into consideration while computing the PF contribution.

my query is how can we implement the provision of said circular plz guide.

Regarding insurance claim of my vehicles

Respected Experts,

I had purchased Ford Figo in March 2012, in which I have taken Adon Policy of Bharti Co. which means 100% Dep. My car got accident and I sent to Authorised Dealer for Claim under my Vehicle Policy of Bharti Co.

As per the Authorised Dealer they told me that I have to paid Service Tax, extra materials charges like nut bolts, greasing & 80% Colour charges, as it won't come under Claim.

Sir whether its true that I have to pay said amount to dealer, because at the time of policy they told me that I have to Pay Rs.500/- only.

Its urgent, Please reply at earliest.

Provident Fund

Sir,

Has the ceiling on Provident fund of Rs 6500/- revised to Rs 10,000/-.

Then can you please clarify, if a person earns 20,000/- as Basic Salary, contribution by the employer will be limited to 12percent of 10,000 or Rs 6500, if the ceiling is not raised.

Legality of E.S.I.C. Contribution

"A" is an establishment covered under E.S.I.C. Act and "B" is an outside agency specialized in doing some specified job. "A" carried out some job work from "B". "B" has performed the jobwork with it's own manpower in it's own premises and submitted a Bill/ Charge of Rs. 50 Lakhs for its services rendered to "A". "A" shown the amount of "B" i.e. Rs. 50 Lakhs in their Books of Account as Processing Charge.

Whether "A" is liable to pay E.S.I. Contribution on this said amount???
