want to know what complainant will do to make settlement in lok adalat
he said to settle case .
if any affidavit or application or what else ? he will have to make or it is not his duty or it is a part of defense ?
what is the procedure ? in lok adalat to make settlement
& what is defense role ?
1 who will initiate in lok adalat ?
2 both parties ? & at the same time ?
3 or defense will have to take first step ?
complainant said he will make settlement but how can i know he is making or not ?

theft in supermart comes in 379 IPC but police written it 380 IPC in FIR
challan is not filed yet
we will have to face problem in compromise this case (380 is non coumpounding )
could we pray i.o. to correct it that is 379 IPC in his challan
so that we get compromise .complainant is ready for settlement

i.o. demands bills of case property from shopkeeper( complainant) before challan
when we meet to complainant to settle case he informed us you donot worry i will not give bills to i.o. complainant assures us i will make your fever & he is waiting reply from his owner
we also met i.o. not to present challan to court till we reach settlement from complanaint
1.i want to know is bills are necessary to prepare challan ??
2. if complainant will not give bills of case property (kept in mallkhana ) till i.o. would not able to make challan ??

my relative put some cloth &grocery item &exit from mall.salesman &other caught him &cut the plastic strip zip tie on his bag (which malls worker had put on his bag before entrance .
zip tie was cut with cutter .
& they saw items &call 100 no. police came &took accused in police Thana
&manager gave CCTV footage &bag with articles to police & filed FIR & accused got jail & bail
my uncle met io (investigation officer) for help he said meet complainant . i can delay to file charge sheet.
&then lokdown is started. & now 17 may (the date of lokdown will stop) is coming soon.
charge sheet date is 21 may
what i can suggest my uncle to be approach to io &complainant as uncle is farmer & illiterate he don't know what to be make in our favor to become accused acquittal.
i am helping him.
could you please
1.can a final report or closure report or any other report may be done to be acquittal.
don't know what is in our favor.
2. can we pray complainant to fabricate his statement in our favor when io will record this in 161 crpc may be .
3.what should we try to that leads accused acquittal.
i am student .i dont know
I pray our counsel he don't want to see us & don't want to hear us .
this does not sounds good.

454 ipc & 380 ipc is written in challan
but charges not framed yet
454 ipc contains ten years punishment
does it means it is session trial ??
challan has produced in MM COURT
& MAGISTRATE is on leave & accuse is appearing in mm court on his date
prosecution case is related to theft in a mall by customer in a busy day time 4 pm
& there is not tress pass
he entered in mall through common entrance as uses by other customer
