Validity of final decree

Helllo my dear experts.........
Is it is valid if final decree was not stamped in N.J stamps.........
is their any remidy for that.........
what are the consequences if final decree was not engroseed on n.J stamp..........

Promissory Note Case Laws

Dear Experts.

I am an advocate and I have been practicing since 21st Oct, 2009.
I have cross examined PW-1 and PW-2 reguarding pronote suit on behalf of Defendant. PW-1 in his Chief affidavit and in my cross examination he stated that he has given debt to Defendant for his family expenses and for the treatment of defendant health. Further he stated that he is doing finance business.

In my cross examination PW-2 stated that who is the father of PW-1 and also attestor of the said pronote like this his son has given the debt to defendant for discharging sundry debts. I questioned him that did your son (PW-1) has licence to do finance business. PW-2 stated that yes PW-1 has licence to do finance business. Even though PW-1 has no licence and not filed the copies of the licence. So PW-2 state falsely.

On the above two grounds is there any case laws to dismiss the suit.

Is the suit maintainable. It is my first case. Kindly suggest me some case laws to dismiss the suit.

no driving licence and driver died in the accident

Driver is not having licence. Heirs of the deceased have filed petition u/s 163a of M. V. Act. Whether maintainable or not? Driver died in an accident. Plz advise.

Section 138 INA

Respected All,

I sent a legal notice through a lawyer to a builder on 2nd JUNE 2010, who is not paying my amount, & his cheque has been bounced three times.

Now even after passing 15 days since receiving notice , still he has not paid me any amount. Now as per law, a case can be filed against him in the court.

MY QUESTION IS :IN HOW MANY DAYS A CASE CAN BE FILED IN THE COURT AFTER PASSING 15 DAYS OF TIME OF NOTICE PERIOD. HE IS COMMITTING TO PAY MY AMOUNT FINALLY BY 30TH JUNE. CAN I WAIT TILL THEN OR GO FOR FILING CASE ?

RECTIFICATION OF INSTRUMENTS

Sir,
I have purchased a land thro'registered sale deed. In this area mentioned is smaller than the actual due to the mistake commited in measuring the plot. Although intention of the seller is clearly expressed in the deed that I am selling entire land of this plot and nothing remained or neither me nor any of my heirs have nothing left and having no concern in this plot. Boundary mentioned is correct. The heir of the seller(is dead) is not ready to sign the rectification deed. So, how can I get it rectified thro' court?

i want to aks the following things.
my friends is going through bad time of his marrige.
he has send two notice to her wife at her parents palce.and she dint reply to any of her notices. .what the next step he should take and under what ground.
evenafter taking seperate palce for staying ,her wife is not doing any thing,my frd has to wash his own cloths,clean up the room,even she is not cooking the food for him.

consumer rights

Dear All,
I bought 300feet pvc pipe from a factory for submersible boring of Rs.28000 on bill. After three hours of trial of submersible bore,some pipes got damaged because it could not resist to the small stones which were put into bore alongside the pipe as per requirement.
However vendor verbally assure me the quality
of the pipes.
Underthecircumstances I bear a loss of Rs.75000 , due to poor quality of the pvc pipe.
Can I go to Consumer forum for the claim.
Please advice?

Road Accident

Sir,

I was on the way from my office, one car
jumped the red light and hit my vehicle (Motorcycle) hence my left leg's two bones broken on 10.02.2009. I lodged the FIR in Sector - 24, Noida. The driver arrested and car was also taken into police station.

I had filed a case at District Court Greater Noida in august, 2009 through an Advocate in Noida.

My query is : I have been called by my advocate in the Court only at the time of filing. Approximately one year is approaching, however when ever I asked to my advocate he is saying hearing is going on. But not ready to give the exact feed back of my case.

Why the court is not called me or my witness even after 11 months completed from the date of filing the case.

How much time will take to final this case.

Please help me.
