Gratuity

Dear sir/mam
I am employee of an educational institute working as assistant professor and completed service period of 5 years. Institute ask me to resign as they have extra faculty in my branch and told me that they relive me on the date of resignation without notice period or 3 month salary and when I asked about gratuity they told me it is a retirement policy so they will not give me gratuity because I am not taking retirement I am leaving job after 5 years only and even told me that I will get gratuity in my last job if I complete 5 years in that job. It is urgent plz give me your valuable suggestions.

Default of police in attending the court

One criminal case was filed before a magistrate court by a defacto complaint which is pending for more than 5 years. For the past 4 years the respondent police did not attend the court. The Magistrate did not take any action against the police despite of my request. Please inform the Act, Section under which action to be initiated.

Husband is not understanding

Hi, am married and I have one baby girl.am staying with in-laws. My problem is my husband is not have any trust on me even though am very transparent with him in all . He knows my bank balance, my passwords etc but if I ask some thing he will not say any thing and says telling something to me is unsafe for him.
Not only my husband even my in-laws also will do the same. If there is any function/Pooja in home they won't say any thing to me. They will say that in the night or morning. They don't include me in any matters.
. My sister in law got. Married. She will get all information even though she stay with her husband but am staying in the same home but I don't have any information .
Is this the correct way in married life. It really hurt's me.

Is there any meaning to stay with them. Please help and suggest.

Printing of advertisement on annuaaudit report,balance sheet

Respected Sir / Madam,

The Annual General Body Meeting of our co-op housing society has been scheduled on 2nd Sep, 2018. The meeting notice is displayed on Notice Board only and it is not circulated to the members of the society yet.

We understood that the executive committee has printed the advertisements on the Audit Report, balance sheet etc. One doctor has sponsored the printing expenses in return of printing of his advertisements on the reports etc.

We would like to know whether it is as per bye laws to display notice only on notice board?

As on date we have not received notice individually as stated in the byelaws nor committee has sent notices to the members who are residing at another places.

Can anyone raise the objection for not receiving AGM notice in time as stipulated in the bye laws.

And is it acceptable to take a sponsorship to print Audit Reports and balance sheet from the sponsorer by publishing his advertisement in the important and valuable reports?

We seek your expert advise.

coal mines provident fund and miscellaneous act, 1948

I have some query regarding interpretation of some clause of above Act please help in interpretation of same.

Section 2(h) of above act is is as follow: -
2 (h) “Pension Fund” means the Pension Fund established under sub-- section (2) of section 3-E.

sub-- section (2) of section 3-E. of above act is as follow : -

3-E (2) Notwithstanding anything contained in section 3, there shall be established, as soon as may be after framing of the Pension Scheme, a Pension Fund into which there shall be paid, from time to time, in respect of every employee who is a member of the Pension Scheme,-—

(a) such sums, not exceeding one-fourth, of the amount payable to the Fund under sub-section (1) of section 10-D as the employer’s contribution as well as the employee’s contribution, as may be specified in the Pension Scheme;

(b) such sums as the Central Government may, after due appropriation made by Parliament by law in this behalf, specify;

(c) the net assets of the Family Pension Fund as existed immediately before the establishment of the Pension Fund; and

(d) any other contribution which may be made to the Pension Fund with the previous approval of the Central Government.

sub-section (1) of section 10-D is as follow : -

10-D. Payment of contribution by employers and recovery thereof from members .—
(1) The contribution shall be payable by the employer (hereinafter referred to as the employer’s contribution) and by the employee (hereinafter referred to as the employee’s contribution) at such rate as may be specified in the Coal Mines Provident Fund Scheme, and the employer shall pay the employer’s contribution as well as the employee’s contribution, whether or not he has recovered from any employee the employee’s share of the contribution.

if contribution rate is 12% by employee and 12% by employer in Coal Mines provident Fund Scheme i.e. 24%.

how much maximum contribution can be made in pension fund as per section 3 E (2).

whether it will be total 6% i.e. 3% by employee and 3% by employer ?
or total it can be 12% i.e. 6% by employee and 6% by employer ?
or whether it can be more than 12 % as per section 3E (2) ?

Right to take leave due to health issues.

Hi, I am working in Top level MNC since 4 yrs. Since last year I am suffering from severe eye infection due to this am not in a position to work with laptop because of
watching laptop , redness in eye increasing and also am having eye burning , eyelid swell.
Due to this eye have requested for long leave for 6months by submitting all medical reports to HR. Request has been rejected by HR and they said that they can give leave only for 1 month.
As a employee can i have right to request for long leave due to health issues.

TERMINATION FROM SERVICE AND ANTICIPATORY BAIL

Dear Sirs
My brother who is a teacher in Bihar Govt and has been flasley implicated in a case by my neighbour with them we had some unresolved cases pending in court of law. They have said in Fir that my brother has fired on them with an unlicensed revolver which missed the hit.

Total 5 people are named in the FIR. It is mentioned in FIR that all have fired on them with unauthorized revolvers. As mentioned in FIR one bullet also hit a person but my brothers fire missed it.
Kindly suggest can my brother be given anticipatory bail from session court if eligible.
Can he be terminated from service even if he gets bail after being in custody for some days. I am a defence person serving away from my home in Bihar and my family members told me not to come home fearing I may also be implicated in false case.
Kindly give ur valuable suggestions.

False dowry case before marriage

Hi, My Roka was done to a girl on 22th April 2018 and was scheduled to marry her on 20th june 2018. As I could not adjust with the girl, I asked my parents to call off the marriage. I had also told the mediator that as I am not able to adjust its better to call off the wedding, but he was just pressurise me and my family to marry her . I also ready to paying all expense which is done in roka by her father . but he Getting angered by this, the girl's father has filed a false dowry case against me and my family. He had spent 1 lac money in booking the hall but is asking double the amount than required. and After that the complainant
raised a false allegation against me, it is completely false and
incorrect statement that I demanded Rs 2,50,000 Lac cash and 1
Scorpio Car Top Model and other valuable items for the marriage. In
reality I didn’t demand anything from the complainant. also he was said to he give us 2.5 lac cash to when he come to my home. that is also totally false. After that the
complainant send 2 persons to my office had threatened and
forced me to do the marriage otherwise we will give harm to you and your family. now i am job less after this bcz my company fire me What should we do ? There is no bank transaction which he can show in the court. I just do not want to be harassed by all this legal drama. So , can you give me some advice ?
