Legal diff in the meaning of Advice & Referral by a doctor

Whether the meaning of Advice & Referral is same in the eyes of Law? and whether a doctor can be prevented by any Rule for not to give 'Advice' to a patient?

Please give your legal comments as in one of the Judgments of MP High court, the Honble Court has said that the meaning of 'Advice' & 'Referral' is same.

Money given to friend to help him

I had given money 4 yr back to help him around 24000.I am trying to get money back but evertime he is giving excuse and not giving any response if I talk him over phone. I am so much in tense because of that. Pls help someone and suggest what to do in this case

Is Emotional attachment a ground for divorce

Hi All,

I am undergoing a divorce and very recently, my wife's father expired.

And I did not go to the funeral as well.

Question:

1. Since, my wife did not made any attempt of sharing this information with me, is a clear indicator of no emotional bond whatsoever between us.

Will this "lack of emotional bond" be a solid ground for divorce.

2. Are there any citations/cases, which conclude above point.

Alimony

Hi All,

I am currently undergoing a divorce(2008) and cureently it is in the stage of Cross examination of witnesses.

I have a few queries about Alimony.

I have submitted my salary slips in the Mainitenance case(2007) which was 2 years back and my salary at that time was 2.4 Lacs PA.

My current take home salary is 3.6 Lacs PA excluding taxes.

Question:

1. What are the grounds to decide alimony for my wife?

2. Will I be asked to submit my latest salary slips?

3. Also in 498a case(2007), my wife alleged of 50 lacs of dowry (which is absolutely wrong) . Will court/judge take into consideration 498a case allegations before granting alimony.

4. Based on above facts, how much alimony can I expect ?

suggestion for a writ in high court

Dear Sir,

Petitioner: Husband of my sister
Respondent: My sister

Petitioner(Husband of my sister)filed a case under s9 of hindu marriage act for restitution of conjugal rights on the basis of that she is living separately. The issues were framed by lower court. After two years the Petitioner(Husband of my sister)filed a case under s13 in the same court on the basis of that there's no restitution of conjugal rights from 2 years. The issues are not framed in s13 case. Petitioner(Husband of my sister) gave an application for the consolidation of both the cases and to make s13 case as leading case. The court gave the petitioner relief and ordered that since both the cases are of same nature so they should be consolidated and s13 case should be the leading case. We filed a revision in district judge court against this order but our revision is dismissed.

My sister has filed a criminal case under 498A before all the above mentioned cases were started. the Petitioner(Husband of my sister) has taken stay from high court in this case. My sister has a baby and she filed a maintenance case (125)in which judge gave maintenance and wrote in his order that there are sufficient reason why my sister is living separately.

Now what we should do for
1. The relief given to Petitioner(Husband of my sister)by lower court and dj court by consolidating s9 and s13 case ans making s13 case as leading case.
2. In how many days we can file a writ in high court against the order.

Please help and Please give some case reference for the similar cases and there orders by high court and supreme court.

CLB petition for not honoring board meeting approval

Sir,
Can I be guided for a petition to be filed in CLB for not honoring a commitment approved by BOD in a meeting by erstwhile GLOBAL TRUST BANK (during its legal existence) later merged with Oriental Bank of Commerce. The proposal was approved by the GTB board and recorded in its minutes book The same was communicated to my clients. OBC now is reluctant to honor the approval which was approved by GTB during its lawful and legal existence.
I want a direction from CLB directing OBC to honor the BOD approval which was done during legal existence of GTB.

right of a girl

if there is only two girls (no boy) of a parents then how can the property divided between them , is there is a right of a girl is vested in mothers income if mother cant give any assets to her and same as wt about fathers property. what is the legal standing of a girl is she is married.
