Case filed under 138 cheque bounce

Hello,
I filed a cheque bounce case of Rs.2 lakhs in Feb 2021 pertaining to refund of my property booking amount which I had paid online from Bangalore to Hubli and the owner withdrew full amount from bank and closed the account and sold the property to another buyer. For almost 12-15 months even after getting notices from Court he did not turn up for taking bail. He came later and without serving notice to my advocate managed to get bail and ran away and again not seen for 2 years. Court issued 9 NBWs and Arrest warrants. On 26th Feb 24, case advanced from 29-4-2024 he came without any notice to my advocate took date and disappeared. I have been given Rs.300 payment orders as complainant by Hon Court. I wonder if such things are permitted by Hon Courts that one accused is escaping so many notices/NBWs/Arrest Warrants. The case is posted for PW-1 CROSS and my advocate do not yet received any intimation from Court/opposite party. I prayed to the Hon Judge to order Ex parte previous date, but did not get orders. My advocate is also in a fix to explain to me. Kindly advise what next for me.

Landlord falsely claiming rent

Hi
we are running a family business for the past 50 years ,It was started by my grandfather and after him my father is running the business ,The shop is located in prime location and it is pagdi system shop, The original owner of the shop has demised 30 years ago and she is sole owner of the shop, she has no children ,but after her demise a lady claimed she is grand daughter of the landlord and landlord transferred the property to her and claimed she is new owner of the property and claiming rent for the said property for the last 30 years,but when we recently enquired about the property we came to know the property hasn't transferred from original owner to this lady and also she is not grand daughter of the landlord she is distant relative of the landlord so she falsely claiming rent all these years,we are paying rent to her and also paying property taxes all these years,Is it possible for us to sue her for falsely claiming rent for the past 30 years and claim refund and also should I stop paying rent in the future ?request experts to clarify the same

Service to foreign citizen in criminal cases

What to do in a situation when the address of the person to be served in foreign country is not known and its a Vriminal case . 498 A , DV and Maintaunace. As per MHA Guidelines for Mutual Legal Assistance the address is mandatory and for Informal letter of Request the there is no Investigation Agency in DV and Maintainace cases. In 498 A case the chargesheet is filed in court under section 299 .Absconding. LOC already issued. Plesse guide. CAn we request Court to direct police to take Interpol help to locate the Foreign Citizen and than serve him.abroad by MHA . Is there any similar case or judgements on such case by any court in India. Please help.

Icici is not providing me tripartite agreement.

My builder, in his RERA submission, said there is a tripartite that exists between the builder, us (the buyers), and the bank (ICICI). I have asked ICICI so many times and sent notices, but they are neither telling me nor giving me the copy of the tripartite agreement.

I even went to the bank to raise a request for the list of documents. That also ICIC is not providing...

What can I do as an aggrieved buyer.... Neither the bank nor the courts are helping...

Encroachment of land/illegal construction

I HAVE PURCHASED A LAND IN 1993 THROUGH A VALID SALE DEED. IN 2017 I HAVE TAKEN A MESUREMENT BY PVT. AMIN, MY LAND HAS SHORT ABOUT 170 SQFT WHERE MY NEIGHBOUR HAS ALREADY MADE ILLEGAL CONSTRUCTION. WHEN WE APPROCH HIM HE HAS ASSURED ME THAT TO REMOVE THE CONSTRUCTION, BUT AFTER SOME TIMES ,HE REFUSED TO DO SO. HE HAS GIVEN ARGUMENT THAT NO ONE CAN REMOVE THE CONSTRUCTION AFTER 12 YEARS OF ADVERSE POSSESSION. HE HAS GIVEN HIS 170SQFT LAND IN ROAD & ENCROCH MY LAND. HE HAS MADE A ONE STOREY BUILDING OVER MY LAND . WHEN WE OPPOSE ,HE HAS NOT MADE ANY CONSTRUCTION OVER THAT WHERE AS HE HAS ALREADY MADE TWO STOREY CONSTRUCTION OVER HIS ACTUAL LAND.I HAVE APPLIED IN ANCHAL OFFICE FOR MEASUREMENT OF LAND & CIRCLE OFFICER HAS GIVEN THE REPORT THAT 170 SQFT LAND IS ENCROCHED BY NEIGHBOUR & MAKE ILLEGAL CONSTRUCTION.. I HAVE GIVEN A LETTER TO SHO ,DYSP,SP,CO,DCLR FOR REMOVING THE ILLEGAL CONSTRUCTION.BUT NO ONE IS READY TO TAKE ANY ACTION.

NOW WHAT I SHOULD DO?

WHAT TYPE OF LEGAL ACTION MAY INITIATED TO REMOVE THE CONSTRUCTION?

IS ADVERSE POSSESSION ACT APPLIED ON MY LAND?

WHAT IS LIMITATION ACT,IS IT APPLIED ON MY ALND?

HOW WE CAN GET OUR LAND,WHICH IS FRONT & FACE OF MY BUILDINGS.I DONOT WANT TO LOOSE IT.

We ARE A CO-OPERATIVE SOCIETY IN NAVI MUMBAI
Tower 1 - 2 watchman (12 hours shift) AT Present (1 watchman 24 hours)
Tower 2 - 2 watchman (12-hour shift) AT Present 1 (watchman 24 hours)
8-row houses-2 watchman (12 hours ) AT Present 1 (watchman 24 hours)
It's Human to make a person work for 24 hours and the only break he takes is toilets and food and returns. The watchmen sleep in the night and security is compromised
What is the best option to take strict action against the Secretary and Chairman since they are adamant about joint registrar/ Labour commissioner / Police station Please advise and if there is any robbery who is responsible

Society secretary resignation

I have resigned as a secretary from my society due to hectic work schedule. I was appointed as a secretary from Nov'23. However now my society chairman and other members are saying I can't resign for two years as they have checked with some officers. How should I handle this situation as I am not able manage my work pressure and society work.
