Builder not giving possession

I booked a flat in 2006 in Ansal golf city Lucknow and paid 30% of amount but till now construction has not started, giving excuse that they are not getting required approval to construct the flat from local authority. went to RERA court but not getting relief, they said either you take your money with 8+1% simple interest or wait for 2024 as stated in WS of promoter but in conciliation there representative said that they don't have any plan to construct the flat on that land. Please help what should i do now.

RERA can't compel you for settlement.Non construction and delivery of possession of flat is most unfair trade practice and deficiency of services of builder.Argue the case on merits and let RERA be decide the case..

You can make a formal complaint if you have lost trust on the builder for formal adjudication of the complaint in terms of the agreement clause. You can also think of filing a case on Consumer Court.

When builder is not constructing, RERA is giving relief by ordering refund of your money with interest. You can avail opportunity.
You can try to file criminal complaint against builder for cheating etc..

1. You have an positive option to file a grievance petition against the Builder /Developer, in the local Consumer Court, for their illegal trade practice, negligence, deficiency, harassment, intimidation, cheating etc.... with proper documentary evidences and you can claim damages /compensation & interest on your investment, and for your physical & mental trauma.
2. FORGET RERA Authority in such matters.

You can complain to RERA through RERA website. Or file a case in District Consumer Forum.
